After two-years of investigations by a highly politicized FBI and a Special Counsel\u00a0stacked with Clinton supporters, Robert Mueller&#8217;s probe has\u00a0resulted in the resignation of National Security Advisor Michael Flynn, the arrests of Paul Manafort and Rick Gates,\u00a0and the indictment of 13 Russian nationals on allegations of\u00a0<a href=\"http:\/\/www.zerohedge.com\/news\/2018-02-16\/special-counsel-robert-mueller-indicts-13-russians-hacking-during-us-election\">hacking the 2016 election<\/a>\u00a0&#8211; along with the raid of Trump&#8217;s personal attorney, Michael Cohen.<\/p>\n<p>The nation has been on the edge of insanity waiting for that much-promised and long awaited link tying President Trump to Vladimir Putin we were all promised, only to find out that there\u00a0<strong>is no link<\/strong>, the deck appears to have been\u00a0<strong>heavily stacked against Donald Trump\u00a0<\/strong>by bad actors operating at the highest levels of the FBI, DOJ, Obama admin and Clinton camp, and the real Russian conspiracy in the 2016 election was the participation of high level\u00a0<a href=\"http:\/\/www.zerohedge.com\/sites\/default\/files\/inline-images\/sources%20%283%29_1.png\">Kremlin sources<\/a>\u00a0used in the anti-Trump dossier that Hillary Clinton paid for.<\/p>\n<p>Now, as the\u00a0out-of-control investigation moves from the headlines and into court,\u00a0<strong>the all-encompassing &#8220;witch hunt,&#8221; as Trump calls it,\u00a0<\/strong><strong>may be\u00a0in serious jeopardy<\/strong>.<\/p>\n<p>As of Friday,\u00a0<b>three separate Judges have rendered harsh setbacks to the Mueller investigation\u00a0<\/b>&#8211; demanding, if you can believe it,\u00a0<u><em>facts<\/em>\u00a0and\u00a0<em>evidence<\/em><\/u>\u00a0to back up the Special Counsel&#8217;s\u00a0claims &#8211; in\u00a0<em>unredacted<\/em>\u00a0format as one Judge demands, or risk having the cases tossed out altogether.<\/p>\n<p><strong>The first major setback happened\u00a0<a href=\"http:\/\/www.zerohedge.com\/news\/2018-02-21\/unexpected-twist-judge-flynn-case-asks-mueller-exculpatory-evidence\">in February<\/a><\/strong>, when the federal judge assigned to the criminal case against Trump&#8217;s former National Security Advisor,\u00a0<em>Judge Emmet G. Sullivan<\/em>\u00a0ordered Mueller&#8217;s team to turn over any &#8220;exculpatory evidence&#8221; to Flynn&#8217;s defense.<\/p>\n<p>Instead, Judge Emmet G. Sullivan issued the order &#8220;sua sponte,&#8221; or at his discretion, invoking the &#8220;Brady Rule&#8221; &#8211;\u00a0<strong>which requires prosecutors to turn over previously unfiled evidence that might have a material impact on a defendant&#8217;s case<\/strong>. Two days before Sullivan issued the order, Mueller filed a motion for a protective order regarding the use of evidence in the case, including &#8220;sensitive materials,&#8221; which would be provided to Flynn&#8217;s lawyers by the office of the Special Counsel.<\/p>\n<p>This\u00a0development generated a significant buzz in conservative circles,\u00a0<strong>with the implication being that perhaps Flynn\u00a0might not have pleaded guilty in light of certain evidence<\/strong>.<\/p>\n<p>We also know that the FBI agents who interviewed Flynn &#8211; one of whom was anti-Trump counterintelligence agent Peter Strzok,\u00a0<strong>did not think Flynn was lying to them &#8211;\u00a0<\/strong>something James Comey was recently\u00a0<strong><a href=\"http:\/\/www.zerohedge.com\/news\/2018-05-05\/fbi-chaos-comey-caught-lie-over-flynn-investigation-anti-trump-lovebird-lisa-page\">caught lying about<\/a>\u00a0<\/strong>himself.<\/p>\n<p><em>Fox<\/em>&#8216;s Judge Andrew Napolitano thought Sullivan&#8217;s decision at the time was a complete bombshell.<\/p>\n<blockquote><p>&#8220;Why would he we want that after General Flynn has already pleaded guilty? That is unheard of. He must suspect a defect in the guilty plea. Meaning,\u00a0<strong>he must have reason to believe that General Flynn pleaded guilty for some reason other than guilt.<\/strong>&#8221; &#8211;<em>Andrew Napolitano<\/em><\/p><\/blockquote>\n<div class=\"max-width-video-wrapper\">\n<div class=\"fluid-width-video-wrapper\"><iframe loading=\"lazy\" id=\"fitvid467147\" src=\"http:\/\/www.youtube.com\/embed\/x8i7d_4dWUc\" width=\"300\" height=\"150\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/div>\n<\/div>\n<p>And as we noted\u00a0<strong><a href=\"http:\/\/www.zerohedge.com\/news\/2018-05-05\/fbi-chaos-comey-caught-lie-over-flynn-investigation-anti-trump-lovebird-lisa-page\">yesterday<\/a><\/strong>, some have suggested that Flynn pleaded guilty due to the fact that\u00a0<strong>federal investigations tend to bankrupt people who aren&#8217;t filthy rich<\/strong>\u00a0&#8211; as was the case with former Trump campaign aide Michael Caputo, who told the Senate Intelligence Committee &#8220;<a href=\"http:\/\/www.zerohedge.com\/news\/2018-05-02\/god-damn-you-hell-ex-trump-aide-slams-senate-over-financial-ruin-caused-russia\"><strong>God damn you to hell<\/strong><\/a>&#8221; after having to sell his home due to mounting legal fees over the inquiry.<\/p>\n<p>\u201cYour investigation and others into the allegations of Trump campaign collusion with Russia are\u00a0<strong>costing my family a great deal of money \u2014 more than $125,000 \u2014 and making a visceral impact on my children<\/strong>.&#8221;<\/p>\n<p>http:\/\/twitter.com\/mflynnJR\/status\/988438381200801792?ref_src=twsrc%5Etfw&#038;ref_url=http%3A%2F%2Fwww.zerohedge.com%2Fnews%2F2018-05-06%2Fmueller-investigation-jeopardy-witch-hunt-accusations-play-out-court&#038;tfw_site=zerohedge<\/p>\n<p>Let&#8217;s not forget about the time\u00a0Mueller&#8217;s team at the FBI massively screwed up the 2001 anthrax case after 9\/11 &#8211;\u00a0<b><a href=\"http:\/\/www.latimes.com\/politics\/la-na-pol-mueller-record-20171122-story.html\">ruining the life<\/a>\u00a0of SAIC employee\u00a0Steven Hatfill\u00a0<\/b>when it mysteriously leaked that he was the FBI&#8217;s prime suspect.\u00a0<strong>Mueller<\/strong>\u00a0assured Congress in a closed-door January, 2003 session that Hatfill\u00a0was their man based on shaky evidence which was later deemed unreliable. Effectively, he needed a scalp. Hatfill was professionally and financially ruined\u00a0until he\u00a0<strong>sued the US Government for $5.8 million<\/strong>.<\/p>\n<blockquote><p>\u201c<strong>It\u2019s like death by a thousand cuts<\/strong>,\u201d Hatfill, who is now 56, says today. \u201cThere\u2019s a sheer feeling of hopelessness.\u00a0<strong>You can\u2019t fight back. You have to just sit there and take it, day after day, the constant drip-drip-drip of innuendo<\/strong>,\u00a0<strong>a punching bag for the government and the press<\/strong>. And the thing was,\u00a0<strong>I couldn\u2019t understand why it was happening to me. I mean, I was one of the good guys.<\/strong>\u201d &#8211;<a href=\"http:\/\/www.theatlantic.com\/magazine\/archive\/2010\/05\/the-wrong-man\/308019\/\"><em>The Atlantic<\/em><\/a><\/p><\/blockquote>\n<p>Then there&#8217;s the judge in the\u00a0<u><strong>Manafort Case<\/strong><\/u>, who\u00a0<strong>excoriated a Special Counsel attorney on Friday\u00a0<\/strong>during a &#8220;motion to dismiss&#8221; hearing. A\u00a0<a href=\"http:\/\/www.zerohedge.com\/news\/2018-05-05\/leaked-transcripts-reveal-courtroom-showdown-between-manafort-judge-and-mueller\">leaked transcript<\/a>\u00a0of the heated exchange between\u00a0attorney Michael Dreeben and\u00a0Eastern District of Virginia Judge T.S. Ellis reveals that\u00a0<strong>the entire Manafort case is in jeopardy if the Special Counsel doesn&#8217;t produce an unredacted copy of the original order from Deputy AG Rod Rosenstein authorizing the original investigation<\/strong>.<\/p>\n<p>Ellis also said that\u00a0<strong>Mueller\u00a0shouldn&#8217;t have &#8220;unfettered power&#8221; to prosecute Manafort for charges that have nothing to do with collusion between the Trump campaign and the Russians,\u00a0<\/strong>and called out the DOJ&#8217;s efforts in the case as an attempt by Mueller\u00a0<strong>to gain leverage over Manafort<\/strong>.<\/p>\n<blockquote><p>&#8220;You really care about what information Mr. Manafort can give you\u00a0<strong>that would reflect on Mr. Trump or lead to his prosecution or impeachment or whatever<\/strong>. That&#8217;s what you&#8217;re really interested in.&#8221; &#8211;<em>Judge Ellis<\/em><\/p><\/blockquote>\n<p>The Judge also notes that the\u00a0Special Counsel&#8217;s\u00a0indictment against Manafort doesn&#8217;t mention:<\/p>\n<p>(1)\u00a0<strong>Russian individuals<\/strong><br \/>\n(2)\u00a0<strong>Russian banks<\/strong><br \/>\n(3)\u00a0<strong>Russian money<\/strong><br \/>\n(4)\u00a0<strong>Russian payments to Manafort<\/strong><\/p>\n<p>To which Dreeben provided an unsatisfactory lawyerly response about how everything is connected to everything (including, apparently, whether Trump paid a woman to keep quiet about consensual sex).<\/p>\n<p><strong>Last<\/strong>\u00a0&#8211;\u00a0<strong>but we&#8217;re\u00a0<em>quite<\/em>\u00a0sure not least<\/strong>, was\u00a0last week&#8217;s ruling by federal Judge Dabney Friedrich, a Trump appointee,\u00a0<strong>denying Mueller a trial delay over the high-profile February indictment of\u00a0<\/strong><u><strong>13 Russians<\/strong><\/u>\u00a0for\u00a0<a href=\"http:\/\/www.zerohedge.com\/news\/2018-02-16\/special-counsel-robert-mueller-indicts-13-russians-hacking-during-us-election\">interfering in the 2016 US election<\/a>.<\/p>\n<p>Mueller accused\u00a013 Russian nationals and three Russian entities &#8211; one of which was\u00a0<strong>Concord Management and Consulting<\/strong>, of &#8220;knowingly and intentionally&#8221; conspiring to interfere with the election by using social media to disparage Hillary Clinton and support Donald Trump.<\/p>\n<p><strong>And Concord Management\u00a0decided to fight it&#8230;\u00a0<\/strong><\/p>\n<p>As\u00a0<em>PowerLine\u00a0<\/em>notes,\u00a0<strong>Mueller probably didn&#8217;t see that coming<\/strong>\u00a0&#8211; and the indictment itself\u00a0was perhaps nothing more than a PR stunt to bolster the Russian interference narrative.<\/p>\n<blockquote><p><strong>I don\u2019t think anyone (including Mueller) anticipated that any of the defendants would appear in court to defend against the charges.\u00a0<\/strong>Rather, the Mueller prosecutors seem to have obtained the indictment to serve a public relations purpose, laying out the case for interference as understood by the government and lending a veneer of respectability to the Mueller Switch Project.<\/p>\n<p>One of the Russian corporate defendants nevertheless hired counsel to contest the charges.\u00a0<strong>In April two Washington-area attorneys \u2014 Eric Dubelier and Kate Seikaly of the Reed Smith firm \u2014 filed appearances in court on behalf of Concord Management and Consulting<\/strong>. Josh Gerstein covered that turn of events for Politico\u00a0<a href=\"http:\/\/www.politico.com\/story\/2018\/04\/11\/russia-company-concord-obtain-lawyers-515432\">here<\/a>. &#8211;<a href=\"http:\/\/www.powerlineblog.com\/archives\/2018\/05\/mueller-would-prefer-not-to.php?utm_source=twitter&amp;utm_medium=sw&amp;utm_campaign=sw\">Powerline Blog<\/a><\/p><\/blockquote>\n<p><em>Politico&#8217;<\/em>s Gerstein notes that by defending against the charges,\u00a0\u201c<strong>Concord could force prosecutors to turn over discovery about how the case was assembled as well as evidence that might undermine the prosecution\u2019s theories<\/strong>.\u201d<\/p>\n<p>In a mad scramble to put the brakes on the case,\u00a0<strong>Mueller&#8217;s team tried to say that Concord never formally accepted the court summons related to the case<\/strong>, wrapping themselves in a &#8220;cloud of confusion&#8221; as\u00a0<em>Powerline<\/em>\u00a0puts it.\u00a0\u201cUntil the Court has an opportunity to determine if Concord was properly served, it would be inadvisable to conduct an initial appearance and arraignment at which important rights will be communicated and a plea entertained.\u201d<\/p>\n<p><strong>The Russians hit back against Mueller&#8217;s attempt to delay<\/strong>\u00a0&#8211; filing a\u00a0<a href=\"http:\/\/redirect.viglink.com\/?format=go&amp;jsonp=vglnk_152565547918812&amp;key=abd7fb656f4225b209f52eeeaddc9f25&amp;libId=jgvjq6t90101xr40000DA1ccofad5ya41d&amp;loc=http%3A%2F%2Fwww.powerlineblog.com%2Farchives%2F2018%2F05%2Fmueller-would-prefer-not-to.php%3Futm_source%3Dtwitter%26utm_medium%3Dsw%26utm_campaign%3Dsw&amp;v=1&amp;out=http%3A%2F%2Fwww.politico.com%2Ff%2F%3Fid%3D00000163-3131-d4e8-a5ff-b7732a9e0000&amp;title=Mueller%20would%20prefer%20not%20to%20%5BWith%20Comment%20by%20John%5D%20%7C%20Power%20Line&amp;txt=here\">response<\/a>\u00a0on Friday to let the court know that\u00a0\u201c<strong>[Concord] voluntarily appeared through counsel as provided for in [the Federal Rules of Criminal Procedure], and further intends to enter a plea of not guilty<\/strong>. [Concord] has not sought a limited appearance nor has it moved to quash the summons.
