Following yesterday’s\u00a0criminal referral<\/a>\u00a0issued to former\u00a0FBI Deputy Director Andrew McCabe, his ex-boss James Comey and several other individuals, alleging\u00a0malfeasance during\u00a0the 2016 US election, the\u00a0Washington Post<\/em>\u00a0reports that\u00a0McCabe was referred to the U.S. Attorney’s Office by the Department of Justice’s internal watchdog.<\/strong><\/p>\n

While\u00a0CNN\u00a0<\/em>suggests that the criminal referral was\u00a0recently issued<\/a>, citing a\u00a0“source familiar with the matter” – the\u00a0Washington Post<\/em>\u00a0says it occurred “some time ago.”<\/p>\n

The referral to the D.C. U.S. Attorney\u2019s Office occurred some time ago,\u00a0after the inspector general concluded McCabe had lied to investigators or his own boss<\/strong>, then-FBI Director James B. Comey,\u00a0on four occasions, three of them under oath<\/strong>. –WaPo<\/a><\/em><\/p><\/blockquote>\n

It is unknown how the D.C. U.S. Attorney’s office has responded to the referral – including whether prosecutors have launched a separate investigation, as a criminal referral does not obligate officials to take action.<\/p>\n

The DOJ, D.C. U.S. Attorney’s Office and a spokeswoman for McCabe declined to comment Thursday.<\/p>\n

DOJ Inspector General Michael Horowitz\u00a0released a report last week<\/a>,\u00a0accusing former FBI Deputy Director Andrew McCabe of\u00a0repeatedly misleading investigators.<\/p>\n

McCabe was fired on March 16\u00a0after the OIG found that he “had made an unauthorized disclosure to the news media and lacked candor – including under oath – on multiple occasions.<\/strong>”<\/p>\n

Specifically,\u00a0McCabe was fired when it was uncovered that he\u00a0authorized\u00a0an F.B.I. spokesman and attorney to tell Devlin Barrett of the\u00a0Wall St. Journal<\/a>, just days before the 2016 election, that the FBI had\u00a0not<\/em>\u00a0put the brakes on a separate investigation into the Clinton Foundation – at a time in which McCabe was coming under fire for his wife taking a $467,500 campaign contribution from Clinton\u00a0proxy<\/s>\u00a0pal, Terry McAuliffe.\u00a0<\/strong><\/p>\n

The\u00a0WSJ<\/i>\u00a0article in question<\/a>\u00a0reads:<\/p>\n

New details show that senior law-enforcement officials repeatedly voiced skepticism of the strength of the evidence in a bureau investigation of the Clinton Foundation, sought to condense what was at times a sprawling cross-country effort, and, according to some people familiar with the matter, told agents to limit their pursuit of the case<\/strong>. The probe of the foundation began more than a year ago to determine whether financial crimes or influence peddling occurred related to the charity.<\/p>\n

Some investigators grew frustrated, viewing FBI leadership as uninterested in probing the charity<\/strong>, these people said.\u00a0Others involved disagreed sharply, defending FBI bosses and saying Mr. McCabe in particular was caught between an increasingly acrimonious fight for control between the Justice Department and FBI agents pursuing the Clinton Foundation case<\/strong>.<\/p><\/blockquote>\n

So McCabe was found to have leaked information to the WSJ in order to combat rumors that Clinton had indirectly bribed him to back off the Clinton Foundation investigation,\u00a0and then lied about it four times to the DOJ and FBI, including twice under oath.<\/strong><\/p>\n

As we\u00a0reported yesterday<\/strong><\/a>, a\u00a0massive battle is brewing between former FBI Director James Comey, and his deputy Andy McCabe\u00a0over exactly who is lying about Comey knowing that McCabe had been leaking self-serving information to the\u00a0Wall Street Journal<\/em><\/strong>.<\/p>\n

Comey stopped by ABC’s\u00a0The View<\/em>\u00a0to peddle his new book,\u00a0A Higher\u00a0Royalty<\/s>\u00a0Loyalty,\u00a0<\/em>where\u00a0he called his former Deputy Andrew McCabe a liar<\/strong>, and admitted that he “ordered the report” which found McCabe guilty of leaking to the press and then lying under oath about it, several times.<\/p>\n

Comey was asked by host Megan McCain how he thought the public was supposed to have “confidence” in the FBI amid revelations that McCabe lied about the leak.<\/p>\n

\u201cIt\u2019s not okay. The McCabe case illustrates what an organization committed to the truth looks like<\/strong>,\u201d Comey said. \u201cI ordered that investigation.<\/strong>\u201d<\/p>\n

Comey then appeared to try and frame McCabe as a “good person” despite all the lying.<\/p>\n

\u201cGood people lie. I think I\u2019m a good person, where I have lied,\u201d Comey said. \u201cI still believe Andrew McCabe is a good person but the inspector general found he lied,<\/strong>\u201d noting that there are “severe consequences” within the DOJ for doing so.<\/p>\n
