{"id":80683,"date":"2017-08-09T16:59:14","date_gmt":"2017-08-09T20:59:14","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=80683"},"modified":"2017-08-09T17:01:59","modified_gmt":"2017-08-09T21:01:59","slug":"police-are-now-killing-unlicensed-pets-because-they-are-contraband","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=80683","title":{"rendered":"Police are now killing unlicensed pets calling them &#8216;contraband&#8217;"},"content":{"rendered":"<h1>Federal Court Rules Unlicensed Pets are \u2018Contraband\u2019 \u2014 Police Can Legally Kill Them<\/h1>\n<p><!--more--><\/p>\n<h3>A federal court just ruled that cops were not responsible for killing a woman&#8217;s three dogs because her pets were legally considered contraband.<\/h3>\n<p>By Jay Syrmopoulos<br \/>\nThe Free Thought Project<\/p>\n<p>Detroit, MI \u2013 Nikita Smith\u00a0<a href=\"http:\/\/www.detroitnews.com\/story\/news\/local\/detroit-city\/2016\/05\/28\/dogs-shot\/85083662\/\" target=\"_blank\" rel=\"noopener\">filed a lawsuit<\/a>\u00a0against the Detroit Police Department after they killed her three dogs during a\u00a0raid of her home in search of pot last year. On Wednesday, a judge absurdly ruled the dogs were considered \u201ccontraband,\u201d noting that Smith had no legal basis to sue the police department for shooting and killing her dogs, due to the canines\u00a0<a href=\"http:\/\/reason.com\/blog\/2017\/03\/24\/detroit-argues-dogs-killed-in-drug-raid\" target=\"_blank\" rel=\"noopener\">not having been properly licensed<\/a>.<\/p>\n<p>Subsequently, the federal civil rights lawsuit filed by Smith after a raid of her home by the Detroit police was dismissed by U.S. District Court Judge George Caram Steeh.<\/p>\n<p>According to a report by\u00a0<a href=\"http:\/\/reason.com\/blog\/2017\/08\/03\/federal-judge-rules-unlicensed-dogs-aren\" target=\"_blank\" rel=\"noopener\">Reason<\/a>:<\/p>\n<blockquote><p>The ruling is the first time a federal court has considered the question of whether an unlicensed pet\u2014in violation of city or state code\u2014is protected property under the Fourth Amendment. Federal courts have established that pets are protected from unreasonable seizures (read: killing) by police, but the city of Detroit argued in a motion in March that Smith\u2019s dogs, because they were unlicensed, were \u201ccontraband\u201d for the purposes of the Fourth Amendment, meaning she had no legitimate property interest in them and therefore no basis to sue the officers or department.<\/p><\/blockquote>\n<p>Sadly, Judge Steeh agreed with the city\u2019s ridiculous assertion that since the dogs were not licensed, they were not a legitimate property interest, thus giving Smith no legal basis to sue either the department or the individual officer\/s that killed her dogs.<\/p>\n<p><strong><em>\u201cThe Court is aware that this conclusion may not sit well with dog owners and animal lovers in general,\u201d<\/em><\/strong>\u00a0the judge Steeh wrote in his opinion.<em>\u00a0\u201cThe reason for any unease stems from the fact that while pet owners consider their pets to be family members, the law considers pets to be property.\u201d<\/em><\/p>\n<p><em>\u201cThe requirements of the Michigan Dog Law and the Detroit City Code, including that all dogs be current with their rabies vaccines, exist to safeguard the public from dangerous animals,\u201d\u00a0<\/em>he continued.<em>\u00a0\u201cWhen a person owns a dog that is unlicensed, in the eyes of the law it is no different than owning any other type of illegal property or contraband. Without any legitimate possessory interest in the dogs, there can be no violation of the Fourth Amendment.\u201d<\/em><\/p>\n<p>Think about that for a moment, the judge is legally equating owning an unlicensed dog, with\u00a0<em>\u201cillegal property or contraband.\u201d<\/em><\/p>\n<p>So, does someone owning an unlicensed car give you no Fourth Amendment protections over it, and does it constitute illegal property or contraband simply because it isn\u2019t licensed with the city\/state?<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Federal judge rules that unlicensed pets are &quot;contraband.&quot; Cops can kill them with (legal) impunity. <a href=\"https:\/\/t.co\/PZ0T0WX42Q\">https:\/\/t.co\/PZ0T0WX42Q<\/a><\/p>\n<p>&mdash; Radley Balko (@radleybalko) <a href=\"https:\/\/twitter.com\/radleybalko\/status\/893152349128151040?ref_src=twsrc%5Etfw\">August 3, 2017<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<div class=\"resize-sensor\"><\/div>\n<h2>Does government somehow have some magical authority to say that if you don\u2019t license your property as they have dictated, then your property is illicit and you have no constitutional protections over it?<\/h2>\n<p>Steeh\u2019s opinion went on to reason that since there was no Fourth Amendment violation, then there is no legal basis for a civil rights claim against the city. Additionally, Steeh ruled that even if the dogs had been recognized as her property, the animals presented an imminent threat to police, thus the suit would have been dismissed anyway.<\/p>\n<p>Much in line with the brutal reality that a massive number of dogs across America are being executed, Smith\u2019s suit labeled the police officers\u2019 actions in her home akin to a \u201cdog death squad.\u201d\u00a0<a href=\"http:\/\/thefreethoughtproject.com\/i-shouldve-killed-too-cops-murder-womans-dogs-cannabis\/\">She noted that officers shot one of the dogs through a closed bathroom door.<\/a>Gruesome photos from the raid revealed a blood-drenched bathroom with Smith\u2019s dog lying in a pool of blood.<\/p>\n<p>In only the past two years, numerous lawsuits have been filed against the Detroit Police Department for executing dogs. Once incident ended with the city paying out $100,000 to settle a suit after police dash cam footage revealed a dog being killed by an officer while still chained up and no threat to officers. The case was one of three lawsuits filed against the DPD for killing dogs during raids in search of cannabis. In another case, filed in June, officers are alleged to have killed a couple\u2019s dogs while they were behind a backyard fence.<\/p>\n<p>The absurdity of raiding people\u2019s homes in an assaultive and violent manner in search of a medicinal plant reeks of government overreach and waste.<\/p>\n<p>The report by Reason noted extremely brutal nature :<\/p>\n<blockquote><p>A Reason investigation last year found the DPD\u2019s Major Violators Unit, which conducts drug raids in the city, has a track record of leaving dead dogs in its wake. One officer had shot 39 dogs over the course of his career before the raid on Smith\u2019s house, according to public records.<\/p>\n<p>That officer is now up to 73 kills, according to the most recent records obtained by Reason.<\/p>\n<p>Two other officers involved in the Smith raid testified during the trial that they had shot \u201cfewer than 20\u201d and \u201cat least 19\u201d dogs over the course of their careers\u2026<\/p>\n<p>Reason\u2019s review of \u201cdestruction of animal\u201d reports filed by Detroit police officers did not find a single instance where a supervisor found that a dog shooting was unjustified.<\/p><\/blockquote>\n<p>Does anyone really believe that the officer with 73 dog killings is doing it to protect themselves and other officers from imminent danger? The wanton disregard for life is astonishing and speaks to the extreme levels of brutality we see taking place on American streets on a daily basis.<\/p>\n<div>\n<div><span class=\"ctaText\">READ MORE:<\/span>\u00a0\u00a0<span class=\"postTitle\">Cops were Hours Late to 9-1-1 Call, When They Finally Showed Up they Killed the Caller&#8217;s Dog<\/span><\/div>\n<\/div>\n<p>Once again highlighting the lack of proper training police receive, Judge Steeh\u2019s opinion noted that the \u201cpolice officers conducting the search had not received any specific training on how to handle animal encounters during raids.\u201d<\/p>\n<p>The court opinion also recognized that Detroit police supervisors found the shooting of Smith\u2019s three dogs all to be justified, but curiously noting:<\/p>\n<p><em>\u201cHowever, as in many other cases, the ratifying officers did so without speaking to the officers about what had transpired,\u201d<\/em>\u00a0the court wrote.<\/p>\n<p>The search warrant for Smith\u2019s residence came after police received a tip that marijuana was being sold out of the home. The raid, which killed her three dogs, netted a total of 25 grams of marijuana \u2013 not even an ounce. Since recent polling support for legalizing cannabis has reached upwards of 80%, perhaps giving police a license to kick down doors, with weapons drawn, in search of a plant, is a recipe for disaster.<\/p>\n<p>Ironically, after the police killed her three dogs, the case against Smith was dismissed due to officers failing to show up for her court hearing.
