Mueller III managed in a dozen years as F.B.I. director to stay above the partisan fray, carefully cultivating a rare reputation for independence and fairness.<\/em><\/p><\/blockquote>\n<p>Let\u2019s fact-check the Times \u2026<\/p>\n<h3>Anthrax Frame-Up<\/h3>\n<p>Mueller presided over the incredibly flawed anthrax investigation.<\/p>\n<p>The U.S. Government Accountability Office says the FBI\u2019s investigation was\u00a0<a title=\"\u201cflawed and inaccurate\u201d\" href=\"http:\/\/www.washingtonsblog.com\/2014\/12\/government-fbis-anthrax-investigation-flawed-inaccurate.html\">\u201cflawed and inaccurate\u201d<\/a>.\u00a0 The investigation was so bogus that a senator\u00a0<a title=\"called for\" href=\"http:\/\/www.washingtonsblog.com\/2011\/02\/senator-there-are-no-more-excuses-for-avoiding-an-independent-review-and-assessment-of-how-the-fbi-handled-its-investigation-in-the-anthrax-case.html\">called for<\/a>\u00a0an \u201cindependent review and assessment of how the FBI handled its investigation in the anthrax case.\u201d<\/p>\n<p>The head of the FBI\u2019s anthrax investigation says\u00a0<a title=\"the whole thing was a sham\" href=\"http:\/\/www.washingtonsblog.com\/2015\/04\/head-fbis-anthrax-investigation-calls-b-s.html\">the whole thing was a sham<\/a>. He\u00a0<a title=\"says\" href=\"http:\/\/www.washingtonsblog.com\/2015\/04\/head-fbis-anthrax-investigation-calls-b-s.html\">says<\/a>\u00a0that the FBI higher-ups \u201cgreatly obstructed and impeded the investigation\u201d, that there were \u201cpolitically motivated communication embargos from FBI Headquarters\u201d.<\/p>\n<p>Moreover, the anthrax investigation head\u00a0<a title=\"said\" href=\"http:\/\/www.washingtonsblog.com\/2015\/04\/head-fbis-anthrax-investigation-calls-b-s.html\">said<\/a>\u00a0that the FBI\u00a0<em>framed<\/em>\u00a0scientist Bruce Ivins.\u00a0 On July 6, 2006, the FBI\u2019s anthrax investigation FBI Plaintiff provided a whistleblower report of mismanagement to the FBI\u2019s Deputy Director pursuant to Title 5, United States Code, Section 2303, which noted:<\/p>\n<blockquote><p><em>(j) the\u00a0<strong>FBI\u2019s fingering of Bruce Ivins as the anthrax mailer<\/strong>; and, (k) the FBI\u2019s subsequent efforts to\u00a0<strong>railroad the prosecution of Ivins in the face of daunting exculpatory\u00a0evidence<\/strong>.<\/em><\/p>\n<p><em>Following the announcement of its circumstantial case against Ivins, Defendants\u00a0<strong>DOJ and FBI crafted an elaborate perception management campaign to bolster their assertion of Ivins\u2019 guilt<\/strong>. These efforts included press conferences and\u00a0<strong>highly selective evidentiary presentations which were replete with material omissions<\/strong>.<br \/>\n<span id=\"more-68066\"><\/span><br \/>\n<\/em><\/p><\/blockquote>\n<p>In other words, Mueller presided over the attempt to frame an\u00a0<a title=\"innocent man\" href=\"http:\/\/www.google.com\/search?q=site%3Awashingtonsblog.com+ivans+not+anthrax&amp;ie=utf-8&amp;oe=utf-8#q=site:washingtonsblog.com+ivins+not+anthrax\" target=\"_blank\" rel=\"noopener\">innocent man<\/a>\u00a0(and\u00a0<a title=\"see this\" href=\"http:\/\/www.washingtonsblog.com\/2008\/08\/ivins-is-the-third-scientist-the-fbi-has-tried-to-pin-the-anthrax-attacks-on.html\">see this<\/a>).<\/p>\n<h3>Unsure About Assassination of U.S. Citizens Living On U.S. Soil<\/h3>\n<p>Rather than saying \u201cof course not!\u201d, Mueller said that he wasn\u2019t sure whether Obama had the right to\u00a0<a title=\"assassinate Americans living on American soil\" href=\"http:\/\/www.washingtonsblog.com\/2012\/03\/fbi-director-have-to-check-to-see-if-obama-has-the-right-to-assassinate-americans-on-u-s-soil.html\">assassinate Americans living on American soil<\/a>.<\/p>\n<p>Constitutional expert Jonathan Turley\u00a0<a title=\"commented\" href=\"http:\/\/jonathanturley.org\/2012\/03\/08\/mueller-i-am-not-sure-whether-i-now-can-kill-citizens-in-the-united-states-under-obamas-kill-doctrine\/\" target=\"_blank\" rel=\"noopener\">commented<\/a>\u00a0at the time:<\/p>\n<blockquote><p><em>One would hope that the FBI Director would have a handle on a few details guiding his responsibilities, including whether he can kill citizens without a charge or court order.<\/em><\/p>\n<p><em>***<\/em><\/p>\n<p><em>He appeared unclear whether he had the power under the Obama Kill Doctrine or, in the very least, was unwilling to discuss that power. For civil libertarians, the answer should be easy: \u201cOf course, I do not have that power under the Constitution.\u201d<\/em><\/p><\/blockquote>\n<h3>Spying on Americans<\/h3>\n<p>Mueller participated in one of the\u00a0<a title=\"greatest expansions of mass surveillance\" href=\"http:\/\/www.washingtonsblog.com\/2012\/12\/americans-the-most-spied-on-people-in-world-history.html\">greatest expansions of mass surveillance<\/a>\u00a0in human history.\u00a0 As we\u00a0<a title=\"noted\" href=\"http:\/\/www.washingtonsblog.com\/2013\/08\/the-most-persuasive-evidence-that-the-government-spies-on-all-americans.html\">noted<\/a>\u00a0in 2013:<\/p>\n<blockquote><p><em>NBC News\u00a0<a title=\"reports\" href=\"http:\/\/twierytter.com\/nbcnightlynews\/status\/342771225195597824\" target=\"_blank\" rel=\"noopener\">reports<\/a>:<\/em><\/p>\n<blockquote><p><em>NBC News has learned that under the post-9\/11 Patriot Act, the government has been collecting records on\u00a0<strong>every phone call made in the U.S.<\/strong><\/em><\/p><\/blockquote>\n<p><em>On March 2011, FBI Director Robert Mueller\u00a0<a title=\"told\" href=\"http:\/\/www.fas.org\/irp\/congress\/2011_hr\/fbi.pdf\" target=\"_blank\" rel=\"noopener\">told<\/a>\u00a0the Senate Judiciary Committee:<\/em><\/p>\n<blockquote><p><em>We put in place technological improvements relating to the capabilities of a database to pull together\u00a0<strong>past emails and future ones as they come in so that it does not require an individualized search<\/strong>.<\/em><\/p><\/blockquote>\n<\/blockquote>\n<p><iframe loading=\"lazy\" src=\"\/\/www.c-span.org\/video\/standalone\/?c4461760\" width=\"512\" height=\"330\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<blockquote><p><em>Remember, the FBI \u2013 unlike the CIA \u2013 deals with internal matters within the borders of the United States.<\/em><\/p>\n<p title=\"a transcript\"><em>On May 1st of this year, former FBI agent Tim Clemente told CNN\u2019s Erin Burnett that all\u00a0<a title=\"a transcript\" href=\"http:\/\/transcripts.cnn.com\/TRANSCRIPTS\/1305\/01\/ebo.01.html\" target=\"_blank\" rel=\"noopener\">present and past phone calls were recorded<\/a>:<\/em><\/p>\n<blockquote>\n<blockquote><p><em>BURNETT: Tim, is there any way, obviously, there is a voice mail they can try to get the phone companies to give that up at this point. It\u2019s not a voice mail. It\u2019s just a conversation. There\u2019s no way they actually can find out what happened, right, unless she tells them?<\/em><\/p>\n<p><em>CLEMENTE: \u201cNo,\u00a0<strong>there is a way. We certainly have ways in national security investigations to find out exactly what was said in that conversation<\/strong>. It\u2019s not necessarily something that the FBI is going to want to present in court, but it may help lead the ainvestigation and\/or lead to questioning of her. We certainly can find that out.<\/em><\/p>\n<p><em>BURNETT: \u201cSo they can actually get that? People are saying, look, that is incredible.<\/em><\/p>\n<p><em>CLEMENTE: \u201cNo,\u00a0<strong>welcome to America. All of that stuff is being captured as we speak whether we know it or like it or not<\/strong>.\u201d<\/em><\/p><\/blockquote>\n<\/blockquote>\n<p><em>The next day, Clemente again appeared on CNN, this time with host Carol Costello, and she asked him about those remarks. He reiterated what he said the night before but added expressly that\u00a0<strong>\u201call digital communications in the past\u201d are recorded and stored<\/strong>:<\/em><\/p>\n<p><em>NSA whistleblowers say that this means that\u00a0<a title=\"the NSA collects \u201cword for word\u201d all of our communications\" href=\"http:\/\/www.washingtonsblog.com\/2013\/08\/nsa-whistleblowers-nsa-collects-word-for-word-every-domestic-communication.html\">the NSA collects \u201cword for word\u201d all of our communications<\/a>.<\/em><\/p><\/blockquote>\n<p>FBI special agent \u2013 and a 2002\u00a0<a title=\"Time Person of the Year\" href=\"http:\/\/www.time.com\/time\/specials\/packages\/0,28757,2022164,00.html\" target=\"_blank\" rel=\"noopener\">Time Person of the Year<\/a>\u00a0\u2013 Colleen Rowley\u00a0<a title=\"writes\" href=\"http:\/\/www.washingtonsblog.com\/2017\/06\/67890.html\">writes<\/a>:<\/p>\n<blockquote><p><em>Mueller\u2019s FBI was also severely criticized by Department of Justice Inspector Generals finding the FBI overstepped the lhttp:\/\/www.washingtonsblog.com\/wp-admin\/post.php?post=68066&amp;action=editaw improperly serving hundreds of\u00a0<a title=\"thousands of \u201cnational security letters\u201d\" href=\"http:\/\/www.pbs.org\/newshour\/bb\/government_programs-jan-june07-patriotact_03-09\/\" target=\"_blank\" rel=\"noopener\">thousands of \u201cnational security letters\u201d<\/a>\u00a0to obtain private (and irrelevant) metadata on citizens, and for\u00a0<a title=\"infiltrating nonviolent anti-war groups\" href=\"http:\/\/www.aclu.org\/news\/fbi-counterterrorism-unit-spies-peaceful-faith-based-protest-group\" target=\"_blank\" rel=\"noopener\">infiltrating nonviolent anti-war groups<\/a>\u00a0under the guise of investigating \u201cterrorism.\u201d<\/em><\/p><\/blockquote>\n<h3>Torture<\/h3>\n<p>FBI special agent Colleen Rowley\u00a0<a title=\"points out\" href=\"http:\/\/www.washingtonsblog.com\/2017\/06\/67890.html\">points out<\/a>:<\/p>\n<blockquote><p><em>Mueller was even okay with the CIA conducting\u00a0<a title=\"torture programs after his own agents warned\" href=\"http:\/\/www.newsweek.com\/ali-soufan-breaks-his-silence-77243\" target=\"_blank\" rel=\"noopener\">torture programs after his own agents warned<\/a>\u00a0against participation. Agents were simply instructed not to document such torture, and any \u201cwar crimes files\u201d were made to disappear. Not only did \u201ccollect it all\u201d surveillance and torture programs continue, but Mueller\u2019s (and then Comey\u2019s) FBI later worked to prosecute NSA and CIA whistleblowers who revealed these illegalities.<\/em><\/p><\/blockquote>\n<h3>Iraq War<\/h3>\n<p>Rowley\u00a0<a title=\"notes\" href=\"http:\/\/www.accuracy.org\/release\/911-whistleblower-rowley-on-muellers-history-of-cover-up\/\" target=\"_blank\" rel=\"noopener\">notes<\/a>:<\/p>\n<blockquote><p><em>When you had the lead-up to the Iraq War \u2026 Mueller and, of course, the CIA and all the other directors, saluted smartly and went along with what Bush wanted, which was to gin up the intelligence to make a pretext for the Iraq War. For instance, in the case of the FBI, they actually had a receipt, and other documentary proof, that one of the hijackers, Mohamed Atta, had not been in Prague, as Dick Cheney was alleging. And yet those directors more or less kept quiet. That included \u2026 CIA, FBI, Mueller, and it included also the deputy attorney general at the time, James Comey.<\/em><\/p><\/blockquote>\n<h3>Post 9\/11 Round-Up<\/h3>\n<p>FBI special agent Rowley also\u00a0<a title=\"notes\" href=\"http:\/\/www.washingtonsblog.com\/2017\/06\/67890.html\">notes<\/a>:<\/p>\n<blockquote><p><em>Beyond ignoring politicized intelligence, Mueller bent to other political pressures. In the aftermath of the 9\/11 attacks, Mueller directed the \u201c<a title=\"post 9\/11 round-up\" href=\"http:\/\/oig.justice.gov\/special\/0306\/full.pdf\" target=\"_blank\" rel=\"noopener\">post 9\/11 round-up<\/a>\u201d of about 1,000 immigrants who mostly happened to be in the wrong place (the New York City area) at the wrong time. FBI Headquarters encouraged more and more detentions for what seemed to be essentially P.R. purposes. Field offices were required to report daily the number of detentions in order to supply grist for FBI press releases about FBI \u201cprogress\u201d in fighting terrorism. Consequently, some of the detainees were brutalized and jailed for up to a year despite the fact that\u00a0<a title=\"none turned out to be terrorists\" href=\"http:\/\/www.nytimes.com\/2015\/06\/18\/us\/immigrants-suit-over-detention-after-9-11-is-revived.html\" target=\"_blank\" rel=\"noopener\">none turned out to be terrorists<\/a>.<\/em><\/p><\/blockquote>\n<h3>9\/11 Cover Up<\/h3>\n<p><span id=\"more-67890\"><\/span>Rowley\u00a0<a title=\"points out\" href=\"http:\/\/www.accuracy.org\/release\/911-whistleblower-rowley-on-muellers-history-of-cover-up\/\" target=\"_blank\" rel=\"noopener\">points out<\/a>:<\/p>\n<blockquote><p><em>The FBI and all the other officials claimed that there were no clues, that they had no warning [about 9\/11] etc., and that was not the case. There had been all kinds of memos and intelligence coming in. I actually had a chance to meet Director Mueller personally the night before I testified to the Senate Judiciary Committee \u2026 [he was] trying to get us on his side, on the FBI side, so that we wouldn\u2019t say anything terribly embarrassing. \u2026<\/em><\/p><\/blockquote>\n<p>But overwhelming evidence shows that\u00a0<a title=\"9\/11 was foreseeable\" href=\"http:\/\/www.washingtonsblog.com\/2008\/04\/911-was-foreseeable.html\">9\/11 was foreseeable<\/a>. Indeed, Al Qaeda crashing planes into the World Trade Center and the Pentagon\u00a0<a title=\"was itself foreseeable\" href=\"http:\/\/www.washingtonsblog.com\/2011\/06\/al-qaeda-flying-planes-into-the-world-trade-center-and-pentagon-was-foreseeable.html\">was itself foreseeable<\/a>. Even the chair of the 9\/11 Commission said that\u00a0<a title=\"the attack was preventable\" href=\"http:\/\/www.cbsnews.com\/stories\/2003\/12\/17\/eveningnews\/main589137.shtml\" target=\"_blank\" rel=\"noopener\">the attack was preventable<\/a>.<\/p>\n<p>Rowley also said\u00a0<a title=\"says\" href=\"http:\/\/www.washingtonsblog.com\/2017\/06\/67890.html\">says<\/a>:<\/p>\n<blockquote><p><em>TIME Magazine\u00a0would probably have not called my own disclosures a \u201c<a title=\"bombshell memo\" href=\"http:\/\/content.time.com\/time\/covers\/0,16641,20020603,00.html\" target=\"_blank\" rel=\"noopener\">bombshell memo<\/a>\u201d to the Joint Intelligence Committee Inquiry in May 2002 if it had not been for Mueller\u2019s having so misled everyone after 9\/11.<br \/>\n<\/em><\/p><\/blockquote>\n<p>In addition, Rowley\u00a0<a title=\"says\" href=\"http:\/\/www.washingtonsblog.com\/2010\/03\/colleen-rowley-minders-ensured-she-didnt-say-anything-about-911-the-fbi-didnt-want-told-even-to-government-officials-with-top-security-clearance.html\">says<\/a>\u00a0that the FBI sent Soviet-style \u201cminders\u201d to her interviews with the Joint Intelligence Committee investigation of 9\/11, to make sure that she didn\u2019t say anything the FBI didn\u2019t like.\u00a0 The chairs of both the 9\/11 Commission and the Official Congressional Inquiry into 9\/11\u00a0<a title=\"said\" href=\"http:\/\/www.washingtonsblog.com\/2010\/03\/chairs-of-both-the-911-commission-and-the-joint-intelligence-inquiry-into-911-said-that-government-minders-obstructed-the-911-investigation.html\">confirmed<\/a>that government \u201cminders\u201d obstructed the investigation into 9\/11 by intimidating witnesses (and\u00a0<a title=\"see this\" href=\"http:\/\/www.newsweek.com\/2015\/01\/23\/information-could-have-stopped-911-299148.html\" target=\"_blank\" rel=\"noopener\">see this<\/a>).<\/p>\n<p>Mueller\u2019s FBI also obstructed the 9\/11 investigation in many other ways. For example,\u00a0 an FBI informant hosted and rented a room to two hijackers in 2000. Specifically, investigators for the Congressional Joint Inquiry\u00a0<a title=\"discovered\" href=\"http:\/\/www.buzzflash.com\/contributors\/05\/11\/con05439.html\" target=\"_blank\" rel=\"noopener\">discovered<\/a>\u00a0that an FBI informant had hosted and even rented a room to two hijackers in 2000 and that, when the Inquiry sought to interview the informant,\u00a0<strong>the FBI refused outright, and then hid him in an unknown location<\/strong>.\u00a0 And\u00a0<a title=\"notes\" href=\"http:\/\/www.nytimes.com\/2004\/09\/08\/politics\/08graham.html\" target=\"_blank\" rel=\"noopener\">see this<\/a>.<\/p>\n<p>And Kristen Breitweiser \u2013 one of the four 9\/11 widows instrumental in forcing the government to form the 9\/11 Commission to investigate the 2001 attacks \u2013\u00a0<a title=\"points out\" href=\"http:\/\/www.washingtonsblog.com\/2016\/07\/59713.html\">points out<\/a>:<\/p>\n<blockquote><p><em>Mueller and other FBI officials had purposely tried to keep any incriminating information specifically surrounding the Saudis out of the Inquiry\u2019s investigative hands. To repeat, there was a concerted effort by the FBI and the Bush Administration to keep incriminating Saudi evidence out of the Inquiry\u2019s investigation. And for the exception of the 29 full pages, they succeeded in their effort.<\/em><\/p><\/blockquote>\n<h3>Conclusion<\/h3>\n<p>Rather than being \u201cabove the fray\u201d, Mueller is an authoritarian and water-carrier for the status quo and the powers-that-be.<\/p>\n<p>As Coleen Rowley\u00a0<a title=\"puts it\" href=\"http:\/\/www.washingtonsblog.com\/2017\/06\/67890.html\">puts it<\/a>:<\/p>\n<blockquote><p><em>It seems clear that based on his history and close \u201cpartnership\u201d with Comey, called \u201cone of the closest working relationships the top ranks of the Justice Department have ever seen,\u201d\u00a0Mueller was chosen as\u00a0<a title=\"Special Counsel\" href=\"http:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2017\/03\/03\/the-flawed-record-of-special-prosecutors-who-create-as-much-controversy-as-they-resolve\/?utm_term=.29989d7a3635\" target=\"_blank\" rel=\"noopener\">Special Counsel<\/a>\u00a0not because he has integrity\u00a0but because he will do what the powerful want him to do.<\/em><\/p>\n<p><em>Mueller didn\u2019t speak the truth about a war he knew to be unjustified.\u00a0He didn\u2019t speak out against torture.\u00a0He didn\u2019t speak out against unconstitutional surveillance.\u00a0And he didn\u2019t tell the truth about 9\/11. He is just \u201ctheir man.\u201d<\/em><\/p>\n<div class=\"code-block code-block-1\"><\/div>\n<\/blockquote>\n<p><a title=\"And\" href=\"http:\/\/www.accuracy.org\/release\/911-whistleblower-rowley-on-muellers-history-of-cover-up\/\" target=\"_blank\" rel=\"noopener\">And<\/a>:<\/p>\n<blockquote><p><em>While not the worst of the bunch, neither Comey nor Mueller deserve their Jimmy Stewart \u2018G-man\u2019 reputations for absolute integrity but have merely been, along the lines of George \u2018Slam Dunk\u2019 Tenet, capable and flexible politicized sycophants to power, that enmeshed them in numerous wrongful abuses of power along with presiding over plain official incompetence.
