(WND photo \/ Joe Kovacs)<\/p><\/div>\n<p>WASHINGTON \u2013 The Democratic National Committee is currently defending the tactics it used last year to rig the presidential primary against Sen. Bernie Sanders in a class-action lawsuit, brazenly telling voters in a court of law that the party is not obligated to run a fair and impartial primary election.<\/p>\n<p>Outraged by how the DNC unfairly boosted former Secretary of State Hillary Clinton\u2019s candidacy and cleared the way for her primary victory, supporters of Sanders and Democratic donors sued the DNC in June 2016 alleging it defrauded its constituents.<\/p>\n<p>During the primaries, the DNC blatantly tilted its primary system in favor of Clinton. Then-DNC chair Debbie Wasserman-Schultz was repeatedly criticized for trying to make the Democratic Party presidential debates as few and low-key as possible, to Clinton\u2019s\u00a0advantage.<\/p>\n<p>Regardless of Sanders\u2019 victories during the primaries and caucuses, superdelegates immediately lined up behind Hillary, guaranteeing Sanders\u2019 defeat.<\/p>\n<p>Internal DNC emails only confirmed allegations of the DNC\u2019s rigged primary system, underscoring deep-rooted corruption.<\/p>\n<p>The trove of DNC emails made public by WikiLeaks revealed top officials within the Democratic National Committee privately conspiring to undermine and antagonize Sanders\u2019 campaign, ultimately resulting in Wasserman-Schultz quitting her post in July 2016.<\/p>\n<p>http:\/\/twitter.com\/BLUpfront\/status\/756561966920007680?ref_src=twsrc%5Etfw&#038;ref_url=http%3A%2F%2Fwww.wnd.com%2F2017%2F05%2Fdnc-we-rigged-primaries-so-what%2F<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Confession: Donna Brazile Admits She Used CNN Position To Pass Debate Questions To Clinton Campaign <a href=\"https:\/\/t.co\/Nc3F29Yxuy\">https:\/\/t.co\/Nc3F29Yxuy<\/a> <a href=\"https:\/\/t.co\/l8e1UuguyT\">pic.twitter.com\/l8e1UuguyT<\/a><\/p>\n<p>&mdash; Election Forum (@Reality_Alert) <a href=\"https:\/\/twitter.com\/Reality_Alert\/status\/843808111655866368?ref_src=twsrc%5Etfw\">March 20, 2017<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Wasserman-Schultz rescinded a ban on donations from lobbyists and PACs when Sanders emerged as a viable challenger to Clinton in late 2015.<\/p>\n<p>The rule change paved the way for the establishment of the Hillary Victory Fund, which Politico uncovered was laundering money to the Clinton campaign under the claims\u00a0of fundraising for state Democratic parties. The Clinton campaign would have been outpaced by the Sanders campaign in fundraising if it were not for the rule change.<\/p>\n<p>Current DNC Chairman and former Secretary of Labor Tom Perez, while campaigning to become the DNC chairman, even <a href=\"http:\/\/www.vox.com\/policy-and-politics\/2017\/2\/9\/14561246\/tom-perez-dnc-race\">admitted <\/a>in February that the Democratic Party primaries were rigged in favor of Clinton.<\/p>\n<p>The class-action lawsuit, Wilding et al v DNC Services Corporation and Deborah \u201cDebbie\u201d Wasserman-Schultz, alleges the DNC violated its own rules on neutrality, presenting itself as a neutral political organization while it elevated Hillary Clinton during the 2016 Democratic Party presidential nominating elections.<\/p>\n<p>During an April 25 hearing, the DNC argued the case should be dismissed. Judge William J. Zloch, a Reagan-appointed senior federal judge for the United States District Court serving the Southern District of Florida, heard oral arguments pertaining to the DNC\u2019s Motion to Dismiss request on April 28.<\/p>\n<p>DNC lawyers justified the party\u2019s right to select candidates through \u201cback-room\u201d deals and tip the scale for the establishment\u2019s preferred primary candidate.<\/p>\n<p>\u201c[I]f you had a charity where somebody said, \u2018Hey, I\u2019m gonna take this money and use it for a specific purpose, X,\u2019 and they pocketed it and stole the money, of course that\u2019s different. But here, where you have a party that\u2019s saying, \u2018We\u2019re gonna, you know, choose our standard bearer, and we\u2019re gonna follow these general rules of the road,\u2019 which we are voluntarily deciding, we could have \u2013 and we could have voluntarily decided that, \u2018Look, we\u2019re gonna go into back rooms like they used to and smoke cigars and pick the candidate that way,&#8217;\u201d DNC attorney Bruce Spiva argued. \u201cThat\u2019s not the way it was done. But they could have. And that would have also been their right, and it would drag the court well into party politics, internal party politics to answer those questions.\u201d<\/p>\n<p>But Article 4, Section 5 of the DNC charter states: \u201cThe chairperson shall exercise impartiality and evenhandedness between the presidential candidates and campaigns. The chairperson shall be responsible for ensuring that the national officers and staff of the Democratic National Committee maintain impartiality and evenhandedness during the Democratic Party presidential nominating process.\u201d<\/p>\n<p>While the DNC charter explicitly stipulates that the DNC chair and their staff must ensure neutrality in the Democratic Party presidential primaries, it is \u201ca discretionary rule that it didn\u2019t need to adopt to begin with,\u201d Spiva asserted.<\/p>\n<p>Furthermore, the DNC lawyer contended, the words \u201cimpartial\u201d and \u201cevenhanded,\u201d used in the DNC charter, are not \u201cself-defining\u201d and can\u2019t be interpreted by a court of law, the DNC lawyer asserted.<\/p>\n<p>Attorneys representing the plaintiffs, Jared Beck and Elizabeth Lee, claimed the argument that the term \u201cimpartial\u201d is ambiguous is absurd.<\/p>\n<p>\u201cI\u2019m shocked to hear that we can\u2019t define what it means to be evenhanded and impartial. If that were the case, we couldn\u2019t have courts,\u201d Beck retorted. \u201cI mean, that\u2019s what courts do every day, is decide disputes in an evenhanded and impartial manner.\u201d<\/p>\n<p>The Democratic Party has a \u201cfiduciary duty\u201d to its contributors, which it disregarded with the false appearance of a fair primary process.<\/p>\n<p>\u201cPeople paid money in reliance on the understanding that the primary elections for the Democratic nominee \u2013 nominating process in 2016 were fair and impartial,\u201d Beck said. \u201cAnd that\u2019s not just a bedrock assumption that we would assume just by virtue of the fact that we live in a democracy, and we assume that our elections are run in a fair and impartial manner. But that\u2019s what the Democratic National Committee\u2019s own charter says. It says it in black and white. And they can\u2019t deny that.<\/p>\n<p>\u201cNot only is it in the charter, but it was stated over and over again in the media by the Democratic National Committee\u2019s employees, including Congresswoman Wassermann-Schultz, that they were, in fact, acting in compliance with the charter,\u201d he added. \u201cAnd they said it again and again, and we\u2019ve cited several instances of that in the case.\u201d<\/p>\n<p>Beck expanded upon the details of the lawsuit in a recent interview with Young Turks.<\/p>\n<p>The judge told both parties at the conclusion of the hearing that he would issue a written order on the DNC\u2019s motion to dismiss the lawsuit.
