{"id":71087,"date":"2017-04-11T10:04:38","date_gmt":"2017-04-11T14:04:38","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=71087"},"modified":"2017-04-11T10:04:38","modified_gmt":"2017-04-11T14:04:38","slug":"texas-bill-to-establish-gold-silver-as-legal-tender-dealing-massive-blow-to-federal-reserve","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=71087","title":{"rendered":"Texas Bill to Establish Gold &#038; Silver as Legal Tender, Dealing Massive Blow to Federal Reserve"},"content":{"rendered":"<p><!--more-->by Claire Bernish<br \/>\nthefreethoughtproject.com<\/p>\n<p>A bill recently introduced in Texas seeks to obliterate the Federal Reserve\u2019s much-maligned monopoly on currency by establishing gold and silver as legal tender \u2014 but the groundbreaking legislation, if passed, would also prohibit those precious metals from being seized by State authorities.<\/p>\n<p>If passed, Texans would secure stability by reclaiming their purchasing power \u2014 without being subject to the whims of The Fed \u2014 an institution widely <a href=\"http:\/\/tenthamendmentcenter.com\/2016\/09\/24\/resurrecting-gold-clause-contracts-at-the-state-level-a-tool-to-undermine-the-fed\/\">regarded<\/a> as a devious manipulator of currencies and markets.<\/p>\n<p>Senator Bob Hall introduced the bill last month, which, the Tenth Amendment Center explains, <i>\u201cdeclares specifically that certain gold and silver coins are legal tender, and prohibits any tax, charge, assessment, fee, or penalty on any exchange of Federal Reserve notes (dollars) for gold or silver. The bill authorizes the payment of taxes and fees in gold &amp; silver in certain circumstances. It would also prohibit the seizure of gold or silver by state authorities.\u201d<\/i><\/p>\n<div align=\"center\"><\/div>\n<p>Further subverting the current economy\u2019s fealty to Dr. Ron Paul\u2019s <a href=\"http:\/\/ronpaulinstitute.org\/archives\/featured-articles\/2014\/february\/16\/at-the-fed-the-more-things-change-the-more-they-stay-the-same\/\">Enemy<\/a> Number One, <a href=\"http:\/\/legiscan.com\/TX\/bill\/SB2097\/2017\">SB 2097<\/a>, as the legislation is better known, would prevent any contracts explicitly to be paid in silver or gold to be instead paid with Federal Reserve notes \u2014 if you agree to pay in precious coins, you cannot then proffer payment in dollars.<\/p>\n<p>Enforcing such contracts legally, the Tenth Amendment Center notes, would encourage their proliferation \u2014 and that of gold and silver coinage.<\/p>\n<p>Constitutional tender expert, William Greene, agrees. He <a href=\"http:\/\/blog.tenthamendmentcenter.com\/2017\/04\/texas-bill-would-establish-gold-and-silver-as-legal-tender-take-on-federal-reserve-money-monopoly\/\">explained<\/a>,<\/p>\n<div align=\"center\"><\/div>\n<p><i>\u201cOver time, as residents of the state use both Federal Reserve notes and silver and gold coins, the fact that the coins hold their value more than Federal Reserve notes do will lead to a \u2018reverse Gresham\u2019s Law\u2019 <\/i><a href=\"http:\/\/fee.org\/resources\/denationalization-of-money\/\"><i>effect<\/i><\/a><i>, where good money (gold and silver coins) will drive out bad money (Federal Reserve notes). As this happens, a cascade of events can begin to occur, including the flow of real wealth toward the state\u2019s treasury, an influx of banking business from outside of the state \u2013 as people in other states carry out their desire to bank with sound money \u2013 and an eventual outcry against the use of Federal Reserve notes for any transactions.\u201d<\/i><\/p>\n<p>Texas law currently mandates all debts and taxes be paid in Federal Reserve Notes and coins issued by the Treasury \u2014 ironic, considering Article I, Section 10 of the U.S. Constitution <a href=\"http:\/\/www.usconstitution.net\/xconst_A1Sec10.html\">states<\/a>,<\/p>\n<p><b>\u201cNo State shall \u2026 make any Thing but gold and silver Coin a Tender in Payment of Debts.\u201d<\/b><\/p>\n<div>\n<div><span class=\"ctaText\">READ MORE:<\/span>\u00a0 <span class=\"postTitle\">Second State in Less Than a Month Challenges Fed, Passes Bill to Treat Gold &amp; Silver as Money<\/span><\/div>\n<\/div>\n<p>It wasn\u2019t until 1913, with the passage of the Federal Reserve Act \u2014 which only came after a concerted, covert campaign by U.S. banking magnates \u2014 that the loosely hybrid system placed massive control of money in the hands of Big Banks with little oversight from the government. But the \u2018central banking\u2019 system has failed to prevent further financial crises \u2014 and has been given even a greater chokehold and increased authority as compensation.<\/p>\n<p>Additionally, fiat currency has become a monster issue \u2014 once gold no longer backed U.S. dollars beginning in 1971, excuses to <i>just print more bills<\/i> naturally multiplied.<\/p>\n<p>Where the public has no voice in the value of Federal Reserve Notes, Texans \u2014 and any states to follow its lead \u2014 could theoretically eschew using dollars, altogether, in favor of payment in gold and silver coins.<\/p>\n<p>As it stands, officials of the Federal Reserve \u2014 a private institution \u2014 make decisions behind closed doors, where collusion and corruption can easily sway opinion away from the public\u2019s, if not world\u2019s, best interests.<\/p>\n<p>Notably, the most efficacious watchdog against such practices in any given industry \u2014 <a href=\"http:\/\/www.campaignforliberty.org\/audit-fed\/\">an independent audit<\/a> \u2014 has never been required of The Fed.<\/p>\n<p><i>\u201cWhile the debasement of the currency is the result of federal policy and banker collusion, the effect is broad and deep,\u201d<\/i> Tenth Amendment Center explains. <i>\u201cWhile there has been talk about reform, or at least an audit of the Fed, it is virtually a certainty that the federal government will never relinquish the power it enjoys through control of the monetary system. \u00a0That said, there are practical steps that can be taken at the state level to promote the use and acceptance of sound money and undermine the Fed\u2019s monopoly on money.\u201d<\/i><\/p>\n<p>If passed, Texas would join a smattering of states instituting sound money policies by returning gold and silver to a status as legitimate currency the metals have enjoyed throughout much of recorded history.<\/p>\n<p>Last June, Texas paved the way for this new bill by <a href=\"http:\/\/blog.tenthamendmentcenter.com\/2015\/06\/signed-by-the-governor-texas-law-establishes-bullion-depository-helps-facilitate-transactions-in-gold-and-silver\/\">establishing<\/a> the first state-level gold depository, where an <i>\u201caccount holder may transfer any portion of the balance of the holder\u2019s depository account by check, draft, or digital electronic instruction to another depository account holder or to a person who at the time the transfer is initiated is not a depository account holder.\u201d<\/i><\/p>\n<p>Should lawmakers side with the financial interests of Texans and pass this legislation, Texas would <a href=\"http:\/\/tenthamendmentcenter.com\/2016\/07\/16\/four-ways-states-can-take-on-the-federal-reserve\/\">join<\/a> Utah, which began recognizing gold and silver coins issued by the United States as legal tender in 2011.<\/p>\n<p>___<br \/>\n<a href=\"http:\/\/thefreethoughtproject.com\/texas-bill-gold-silver-money-federal-reserve\/\">http:\/\/thefreethoughtproject.com\/texas-bill-gold-silver-money-federal-reserve\/<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-71087","post","type-post","status-publish","format-standard","hentry","category-uncategorized"],"_links":{"self":[{"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=\/wp\/v2\/posts\/71087","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=71087"}],"version-history":[{"count":0,"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=\/wp\/v2\/posts\/71087\/revisions"}],"wp:attachment":[{"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=71087"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=71087"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/stateofthenation2012.com\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=71087"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
