In a government lawsuit, it has\u00a0a different message.<\/h3>\n<p>by Shahien Nasiripour<\/p>\n<p>Over the past several years, Jack Remondi, chief executive of student loan giant Navient Corp., has gone out of his way to tout the company\u2019s devotion to helping Americans cope with student debt.<\/p>\n<p>He\u2019s mentioned it in meetings with investors, on calls with Wall Street analysts, in testimony before Congress, and even on his Medium blog. \u201cAt Navient, our priority is to help each of our 12 million customers successfully manage their loans in a way that works for their individual circumstances,\u201d he said\u00a0<a href=\"http:\/\/medium.com\/@JackRemondi\/what-cfpb-consumer-data-prescribes-for-student-loans-ab46b8e62179\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/what-cfpb-consumer-data-prescribes-for-student-loans-ab46b8e62179\">March 20<\/a>.<\/p>\n<p>But faced with a potential multi-billion dollar lawsuit by the federal government for not living up to that mantra, Remondi\u2019s company, formerly an arm of student lender Sallie Mae, sang a different tune in court filings.<\/p>\n<p>Borrowers can\u2019t reasonably rely on America\u2019s largest student loan servicer to counsel them about their many options, Navient said on March 24 in a motion to dismiss the case, because its primary role is, after all, to collect their payments.<\/p>\n<p>\u201cThere is no expectation that the servicer will act in the interest of the consumer,\u201d Navient said in response to the litigation <a href=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-sues-nations-largest-student-loan-company-navient-failing-borrowers-every-stage-repayment\/\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-sues-nations-largest-student-loan-company-navient-failing-borrowers-every-stage-repayment\/\">filed Jan. 18<\/a> by the U.S. Consumer Financial Protection Bureau.<\/p>\n<aside class=\"pullquote\">\n<p class=\"passage\">Navient says its public statements encouraging borrowers to contact the company didn\u2019t mean it would act in their best interest.<\/p>\n<\/aside>\n<p>With about <a href=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-concerned-about-widespread-servicing-failures-reported-by-student-loan-borrowers\/\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-concerned-about-widespread-servicing-failures-reported-by-student-loan-borrowers\/\">one in four<\/a> of the nation\u2019s roughly <a href=\"http:\/\/www.newyorkfed.org\/microeconomics\/databank.html\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.newyorkfed.org\/microeconomics\/databank.html\">44 million<\/a> student debtors either in default or struggling to stay current, there\u2019s broad agreement that loan servicers such as\u00a0Navient are key to ending the crisis. Remondi, 54, has <a href=\"http:\/\/medium.com\/@JackRemondi\/what-cfpb-consumer-data-prescribes-for-student-loans-ab46b8e62179\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/what-cfpb-consumer-data-prescribes-for-student-loans-ab46b8e62179\">said<\/a> as <a href=\"http:\/\/medium.com\/@JackRemondi\/4-ideas-for-a-better-student-loan-program-a-common-sense-recipe-for-reform-521e651d612\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/4-ideas-for-a-better-student-loan-program-a-common-sense-recipe-for-reform-521e651d612\">much<\/a> on several <a href=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\">occasions<\/a>. One of his four ideas to slash defaults is for policymakers to <a href=\"http:\/\/medium.com\/@JackRemondi\/four-recommendations-to-improve-student-loan-success-94488bf0bb7f\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/four-recommendations-to-improve-student-loan-success-94488bf0bb7f\">encourage<\/a> borrowers to call their loan servicer. \u201cFor some borrowers, student loan debt can be especially daunting. The good news is that borrowers can turn to their student loan servicers for help to navigate the complex repayment options,\u201d Remondi <a href=\"http:\/\/medium.com\/@JackRemondi\/4-ideas-for-a-better-student-loan-program-a-common-sense-recipe-for-reform-521e651d612\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/4-ideas-for-a-better-student-loan-program-a-common-sense-recipe-for-reform-521e651d612\">said<\/a> in February.<\/p>\n<p>But in court, Navient made clear that the company\u2019s main job isn\u2019t helping debtors; it\u2019s getting them to cough up cash for creditors like its biggest client, the U.S. Department of Education. The department, Navient explained, didn\u2019t agree to pay for the level of customer service the CFPB wants Navient to give.<\/p>\n<p>\u201cThis ranks among the most appalling statements I have heard in my career,\u201d said David Bergeron, who after more than 30 years of working at the Education Department recently retired as the head of postsecondary education. \u201cIf that\u2019s all they are doing,\u201d Bergeron said of Navient\u2019s claim that its only responsibility is to collect, \u201cthe Treasury Department and the Internal Revenue Service would do it better.\u201d<\/p>\n<p>\u201cWhat this means for the Education Department is that it needs to fire Navient,\u201d Bergeron said. \u201cDamn the costs.\u201d<\/p>\n<p>Patricia Christel, a Navient spokeswoman, declined to make Remondi available for an interview. The company helps borrowers \u201cnavigate loan repayment through proven solutions,\u201d she said in a prepared statement. In court, Navient has also sought to undercut the lawsuit by arguing that the CFPB\u2014under siege by a Republican-controlled Congress and White House\u2014is itself unconstitutional.<\/p>\n<aside class=\"pullquote\">\n<p class=\"passage\">Navient steered struggling borrowers facing long-term hardship into payment plans that temporarily postponed bills, the CFPB alleges.<\/p>\n<\/aside>\n<p>In January, the CFPB sued Navient in a Pennsylvania federal court, alleging the company \u201c<a href=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-sues-nations-largest-student-loan-company-navient-failing-borrowers-every-stage-repayment\/\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-sues-nations-largest-student-loan-company-navient-failing-borrowers-every-stage-repayment\/\">systematically<\/a>\u201d cheated student debtors by taking shortcuts to minimize its own costs. Navient illegally steered struggling borrowers facing long-term hardship into payment plans that temporarily postponed bills, the government alleged, rather than helping them enroll in plans that cap payments relative to their earnings.<\/p>\n<p>The latter option promises debtors the possibility of debt forgiveness after years of steady payment. The former raises the possibility of a financial time-bomb.<\/p>\n<p>Navient chose the former, the CFPB said, because it took less time for its employees to set up. Borrowers can typically enroll in so-called forbearance plans over the phone, while income-based repayment plans require paperwork and lots of explanation.<\/p>\n<figure class=\"figure-expandable\" data-type=\"image\" data-id=\"311901160\" data-thumbnail=\"http:\/\/assets.bwbx.io\/images\/users\/iqjWHBFdfxIU\/i02DTGqZtTt4\/v0\/460x260.jpg\" data-align=\"center\">\n<div class=\"image\">\n<div id=\"lazy-img-311901160\" class=\"lazy-img\"><img decoding=\"async\" class=\"aligncenter lazy-img__image loaded\" src=\"http:\/\/assets.bwbx.io\/images\/users\/iqjWHBFdfxIU\/i02DTGqZtTt4\/v0\/800x-1.jpg\" data-native-src=\"http:\/\/assets.bwbx.io\/images\/users\/iqjWHBFdfxIU\/i02DTGqZtTt4\/v0\/-1x-1.jpg\" \/><\/div>\n<\/div><figcaption>\n<div class=\"news-figure-caption-text caption\">\n<h5>Jack Remondi, president and chief executive of Navient, formerly the servicing arm of Sallie Mae, in 2014 &#8211; Photographer: Paul Morigi\/AP Images for Reading Is Fundamental<\/h5>\n<\/div>\n<\/figcaption><\/figure>\n<p>In July 2013, when Navient was the servicing arm of Sallie Mae, Remondi said in an earnings call that \u201cit\u2019s very expensive work, for example, to enroll a borrower into something like an income-based repayment program \u2026 which we are doing. But we don\u2019t actually get paid for outperformance in that side of the equation.\u201d<\/p>\n<p>By pushing distressed debtors into forbearance agreements, the CFPB said, Navient\u2019s conduct violated a <a href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-111publ203\/pdf\/PLAW-111publ203.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/PLAW-111publ203\/pdf\/PLAW-111publ203.pdf\">federal law<\/a>\u00a0(PDF) banning \u201cabusive\u201d practices.<\/p>\n<p>The Education Department and Navient repeatedly encouraged borrowers to contact the company if they had trouble meeting their obligations, the CFPB said in its complaint. Through statements on the websites of both the <a href=\"http:\/\/www.navient.com\/loan-customers\/postponing-payments\/avoiding-default\/\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/www.navient.com\/loan-customers\/postponing-payments\/avoiding-default\/\">company<\/a> and the <a href=\"http:\/\/studentaid.ed.gov\/sa\/repay-loans\/understand\/servicers\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/studentaid.ed.gov\/sa\/repay-loans\/understand\/servicers\">government<\/a>, debtors were prodded to reach out. But when they did, Navient employees allegedly sought to exploit their lack of knowledge and steer them into payment plans more beneficial to Navient, the CFPB said.<\/p>\n<p>The consumer protection bureau estimates that as much as $4 billion in additional\u00a0interest charges were added to principal balances of loans repeatedly placed in forbearance. The CFPB seeks an injunction barring such conduct, modification of existing payment agreements, and restitution to affected students.<\/p>\n<p>\u201cThe Education Department ultimately is asking loan servicers to act on its behalf to fulfill its fiduciary responsibility to borrowers,\u201d Bergeron said, and the government \u201cexpects its servicers to make sure that borrowers gain access to income-based repayment plans.\u201d The CFPB argued in its complaint that this was decidedly not the case with Navient.<\/p>\n<aside class=\"pullquote\">\n<p class=\"passage\">\u201cIt\u2019s a sound legal argument, but it may not be the best public relations argument.\u201d<\/p>\n<\/aside>\n<p>Navient has repeatedly denied the government\u2019s\u00a0 allegations, pointing to how more than 40 percent of loan balances it services for the Education Department are enrolled in income-based <a href=\"http:\/\/studentaid.ed.gov\/sa\/about\/data-center\/student\/portfolio\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/studentaid.ed.gov\/sa\/about\/data-center\/student\/portfolio\">repayment plans<\/a>. Borrowers with Navient-serviced federal loans are less likely to default within the first three years of payments than the national average, company spokeswoman Christel argued, citing the company\u2019s internal data.<\/p>\n<p>However, an analysis of the most recent <a href=\"http:\/\/studentaid.ed.gov\/sa\/about\/data-center\/business-info\/contracts\/loan-servicing\/servicer-performance#05312016\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/studentaid.ed.gov\/sa\/about\/data-center\/business-info\/contracts\/loan-servicing\/servicer-performance#05312016\">federal figures<\/a> shows that 30 percent of Navient-serviced borrowers are behind on their payments\u2014the worst rate among the Education Department\u2019s loan contractors. CFPB data also <a href=\"http:\/\/files.consumerfinance.gov\/f\/documents\/201703_cfpb_Monthly-Complaint-Report.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/files.consumerfinance.gov\/f\/documents\/201703_cfpb_Monthly-Complaint-Report.pdf\">show<\/a>\u00a0(PDF) that Navient ranks seventh on a list of the nation\u2019s most recently complained-about financial companies.<\/p>\n<p>In its motion to dismiss the consumer bureau\u2019s <a href=\"http:\/\/files.consumerfinance.gov\/f\/documents\/201701_cfpb_Navient-Pioneer-Credit-Recovery-complaint.pdf\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/files.consumerfinance.gov\/f\/documents\/201701_cfpb_Navient-Pioneer-Credit-Recovery-complaint.pdf\">complaint<\/a>\u00a0(PDF), Navient argued that borrowers couldn\u2019t \u201creasonably rely\u201d on the company to counsel them about their options, because federal law doesn\u2019t require it. Furthermore, Navient said, its public statements encouraging borrowers to contact the company didn\u2019t mean Navient would act in borrowers\u2019 best interests. Its only legal duty is to lenders, it argued.<\/p>\n<aside class=\"pullquote\">\n<p class=\"passage\">\u201cWhen consumers call their servicers, they\u2019re not expecting them to withhold information.\u201d<\/p>\n<\/aside>\n<p>\u201cIt\u2019s rare for a company to be this bold,\u201d said Jenny Lee, a former CFPB attorney now with the law firm Dorsey &amp; Whitney LLP in Washington. \u201cIt\u2019s a sound legal argument, but it may not be the best public relations argument.\u201d<\/p>\n<p>Suzanne Martindale, a San Francisco-based attorney for Consumers Union, the advocacy arm of Consumer Reports, said Navient\u2019s claim raises questions as to whether borrowers are afforded their right to apply for income-based repayment plans. Bergeron, the former Education Department official, and Rohit Chopra, formerly a student loan regulator with the CFPB, added that they couldn\u2019t recall ever hearing\u2014in public or private\u2014a loan servicer arguing that it wasn\u2019t required to counsel borrowers about their options.<\/p>\n<p>\u201cWhen consumers call their servicers, they\u2019re not expecting them to withhold information,\u201d Chopra said.<\/p>\n<p>If anything, a close review of Navient\u2019s utterances outside of court revealed a consistent message of commitment to helping borrowers manage their student loans.<\/p>\n<p>Last May, for example, Remondi wrote on his <a href=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\">blog<\/a> that \u201cat Navient, we make it a priority to educate our federal borrowers about income-driven options,\u201d because, he explained, the government\u2019s various income-based repayment plans \u201care our primary tool in helping borrowers avoid default.\u201d<\/p>\n<p>Almost two years earlier, in September 2014, Remondi told investors at a Wall Street conference that the typical borrower doesn\u2019t know the difference between the government\u2019s various income-based repayment plans. \u201cOur job as a servicer,\u201d Remondi explained, \u201cis to really work with those customers and make sure that they understand the differences and which program best fits their to reorient their culture toward a more consumer-focused approach, said Lee, the former CFPB lawyer. \u201cBut then there\u2019s a perverse incentive,\u201d she said. \u201cIf a company does too good of a job advertising how consumer-friendly it is, the CFPB could use it as evidence against the company\u2014in that it created this reasonable expectation that consumers can rely on the company.\u201d<\/p>\n<p>\u201cIt\u2019s a really serious dilemma,\u201d she said.<\/p>\n<p>This conundrum may have ensnared Navient. \u201cIf borrowers are led to believe that calling their servicer is useless, who benefits?\u201d Remondi <a href=\"http:\/\/medium.com\/@JackRemondi\/four-recommendations-to-improve-student-loan-success-94488bf0bb7f\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/four-recommendations-to-improve-student-loan-success-94488bf0bb7f\">said<\/a> last year. \u201cHelp is a <a href=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\" target=\"_blank\" rel=\"nofollow noopener\" data-web-url=\"http:\/\/medium.com\/@JackRemondi\/its-time-to-put-students-first-7cd578ca266e\">phone call
