{"id":61811,"date":"2016-12-31T07:37:46","date_gmt":"2016-12-31T11:37:46","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=61811"},"modified":"2016-12-31T07:37:46","modified_gmt":"2016-12-31T11:37:46","slug":"top-10-stupidest-new-laws-in-california-for-2017","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=61811","title":{"rendered":"Top 10 stupidest new laws in California for 2017"},"content":{"rendered":"<p><!--more--><div id=\"attachment_61812\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/12\/JerryBrownSigns-640x480.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-61812\" class=\"size-full wp-image-61812\" src=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/12\/JerryBrownSigns-640x480.jpg\" alt=\"\" width=\"640\" height=\"480\" srcset=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/12\/JerryBrownSigns-640x480.jpg 640w, https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/12\/JerryBrownSigns-640x480-300x225.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><p id=\"caption-attachment-61812\" class=\"wp-caption-text\">Kevork Djansezian\/Getty Images<\/p><\/div><\/p>\n<h2>I\u2019m not in the habit of complaining at the outset of a column, but I\u2019ve taken on a nearly impossible task \u2014 figuring out which, of the hundreds of new California laws about to go into effect, are the stupidest.<\/h2>\n<p>by Assemblyman Tim Donnelly<\/p>\n<p>Don\u2019t laugh.\u00a0 I\u2019m serious.<\/p>\n<p>It\u2019s really, really hard to keep the list at 10 with hundreds of hare-brained schemes that became real laws.<\/p>\n<p>After all, for far too long, the California legislature has been a \u201cconservative-free zone\u201d\u00a0\u2014 even though there were a handful of \u201cRepublicans\u201d occupying seats and taking up space.<\/p>\n<p>I\u2019m going to list the new laws in order of their egregiousness to me, but I\u2019m open to additions or wholesale re-ordering if you care to comment.<\/p>\n<p>Given that Californians are facing 898 new laws going into effect on January 1st, 2017, there\u2019s plenty to hate.<\/p>\n<ol>\n<li><b>Prop. 63:\u00a0\u201c2nd Amendment Nullification\u201d Act<\/b>.\u00a0 Although various portions go into effect in various years \u2014 yes, they staggered implementation of this \u201ccritically needed reform,\u201d some out to 2019 \u2014 this is the most sweeping assault on our long-cherished, God-given natural right as Americans to protect our lives and our freedom. \u00a0It requires you to pass a background check and pay for a permit to buy ammunition for the gun you may have just passed a background check to buy.\u00a0 Yeah, that\u2019ll stop criminals \u2014 who buy their guns and ammo in parking lots from other criminals. WooHoo! Next, it makes high-capacity magazine (any magazine that holds more than 10 rounds) illegal to possess \u2014 even if you bought it prior to the current ban and ownership was previously considered grandfathered.\u00a0 This law should make it clear that the goal of the left is not \u201csafety\u201d \u2014 it\u2019s control.<\/li>\n<li><b>SB880:\u00a0\u201cBullet Button Ban.\u201d\u00a0<\/b> For years, California Democrats have sought to ban a made-up classification of semi-auto rifles with \u201cevil features\u201d that they re-named \u201cassault weapons\u201d for propaganda purposes. Every year, California Democrats attempt to increase control over this \u201chated group\u201d of guns \u2014 until they finally outright ban all semi-automatics.\u00a0 This law will not do a single thing to further public safety, as the San Bernardino terrorist attack illustrated \u2014 determined mass murderers will simply ignore and work around all gun control laws \u2014 as if they are just words on paper. One last bit of irony: in a previous legislative session, this same bill was sponsored by none other than disgraced State Senator Leland Yee. If that name sounds familiar, you\u2019re right.\u00a0 Leland Yee wanted to \u201cprotect\u201d Californians from \u201cassault weapons\u201d on our streets \u2014 that is, until he was arrested for trafficking fully automatic weapons and rocket-propelled grenades in exchange for campaign contributions.\u00a0 He\u2019s currently serving a five-year prison sentence.<\/li>\n<li><b>SB3: Minimum Wage Hike to $15\/hour by 2020<\/b>.\u00a0 As a result of a strong socialist push by unions and complicit governments \u2014 such as the union-controlled California legislature\u2014businesses are looking to eliminate as many jobs as possible, investing in automation instead. When you combine this with unchecked illegal immigration \u2014 where you have an unlimited labor pool willing to work for subpar wages under the table \u2014 the future for entry-level jobs and small business owners in California is bleak.<\/li>\n<li><b>AB1785 The \u201cHands Free\u201d Law.<\/b>\u00a0 This is another example of government gone wild.\u00a0 AB1785 prescribes driver behavior so severely that in and of itself, I believe it will cause more accidents \u2014 and more deaths.\u00a0 Not only must the phone be dash mounted \u2014 meaning you\u2019ll have a permanent distraction right in front of you \u2014 but you may not text, take photos or video, or enter GPS destinations while driving. Fat chance of stopping those activities with a mere $20 fine. The bill does stipulate that \u201cthe only time a driver is allowed to touch the device is when he or she is activating or deactivating a \u201cfeature or function.\u201d However, that process should only involve a <a class=\" x5l\" href=\"http:\/\/mynewsla.com\/government\/2016\/12\/27\/cell-phone-driving-outlawed-unless\/\" target=\"_blank\" rel=\"noopener\">\u201csingle swipe or tap of the driver\u2019s finger,\u201d<\/a> according to the bill,\u201d mynewsla.com reports. \u00a0 How about \u201chands off\u201d my phone instead of an unenforceable \u201chands free\u201d law?<\/li>\n<li><b>AB 1732: Single-User Restrooms<\/b>.\u00a0 If you\u2019ve ever had to go so badly that you used the opposite sex restroom at a gas station or Starbucks, then perhaps you think this law is needed. But do we really need another law regulating bathrooms? Some businesses have already put signs on their single-use restrooms designating use by either sex.\u00a0 And sometimes people just take it upon themselves. I can\u2019t help but think this law is unnecessary and diminishes us as a society a little.<\/li>\n<li><b>SB 1383: Controlling Cow Flatulence<\/b>.\u00a0 Not making this up.\u00a0 In spite of the fact that 53 California dairy farmers went bankrupt, moved out of state, or just closed down this year, the Marxist-Progressives are back at it again. <a href=\"http:\/\/www.breitbart.com\/california\/2016\/11\/30\/cow-farts-california-new-hot-air-obsession\/\">Capture cow farts or suffer heavy fines<\/a>.\u00a0 CARB (CA Air Resources Board) suggests inserting a tube into the cow\u2019s digestive system and venting into a backpack.\u00a0 Even <a class=\" x5l\" href=\"http:\/\/www.latimes.com\/local\/california\/la-me-climate-fight-20161108-story.html\" target=\"_blank\" rel=\"noopener\">liberals admit<\/a> that laws like this, where government tries to control the uncontrollable, can have <a class=\" x5l\" href=\"http:\/\/www.latimes.com\/local\/california\/la-me-climate-fight-20161108-story.html\" target=\"_blank\" rel=\"noopener\">undesirable economic consequences<\/a>.\u00a0 Lost jobs, lost industries, lost revenue. Stupid law.<\/li>\n<li><b>AB 857: Ghost Gun Ban<\/b>.\u00a0 Even if you manufacture your own gun \u2014 starting with an 80% receiver \u2014 that requires you to have special skills and tools to complete the machining, you must now register it and obtain a serial number from the California Department of Justice.\u00a0 The purpose of this law is simply to record your name and your firearm on a list for eventual confiscation.\u00a0 Once again, control \u2014 not public safety \u2014 is the goal.<\/li>\n<li><b>SB1322: Legalizing Child Prostitution.<\/b>\u00a0This law bars law enforcement from arresting sex workers who are under the age of 18 for soliciting or engaging in prostitution, or loitering with intent to do so.\u00a0 So teenage girls (and boys) in California will soon be free to have sex in exchange for money without fear of arrest or prosecution.\u00a0 Now that is nuts. I understand the idea of trying to not punish the victim, but certainly granting judges discretion is better than legalizing and therefor \u201cgreen-lighting\u201d behavior that is so harmful to the individual child.<\/li>\n<li><\/li>\n<li><b>Prop. 57:<\/b>\u00a0 <b>Early Release for so-called Non-Violent Criminals.<\/b>\u00a0 This was Governor Jerry Brown\u2019s baby \u2014 the crown jewel of his prison reform initiatives. Among those offenses he considers \u201cnon-violent\u201d:\u00a0 rape of an unconscious person; human trafficking involving sex acts with minors; and assault with a deadly weapon. Blogger <a class=\" x5l\" href=\"http:\/\/thefederalist.com\/2016\/12\/15\/californias-new-ballot-initiatives-prove-residents-live-fantasy-world\/#.WFLC468Y8MM.twitter\" target=\"_blank\" rel=\"noopener\">Felicia Wilson summed it up well<\/a>\u00a0(original emphasis):\u00a0 \u201c\u2026Call me crazy, but shouldn\u2019t a crime that includes the word <em>rape<\/em> or <em>assault<\/em> be considered, I don\u2019t know\u2026 <em>violent<\/em>?\u201d<\/li>\n<li><b>AB 246<\/b><strong>6:\u00a0Felons Voting.<\/strong> Low-Level felons serving sentences outside of state prison get to keep their right to vote.\u00a0 Hmm. Wonder which party this could possibly help?\u00a0 Just like the \u201cillegal alien vote,\u201d\u00a0\u00a0Democrats will have the felon vote locked down. This is simply about protecting their power and making it permanent.<\/li>\n<\/ol>\n<p>When California Democrats promised to take to the streets to defend the rights of convicted felons, illegal aliens and welfare recipients, they weren\u2019t kidding.
