{"id":61006,"date":"2016-12-20T19:20:25","date_gmt":"2016-12-20T23:20:25","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=61006"},"modified":"2016-12-20T19:20:25","modified_gmt":"2016-12-20T23:20:25","slug":"search-warrant-used-to-obtain-clinton-emails-during-weiner-probe-released","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=61006","title":{"rendered":"Search Warrant Used to Obtain Clinton Emails During Weiner Probe Released"},"content":{"rendered":"<p><!--more-->by Chris White<a title=\"Posts by Chris White\" href=\"http:\/\/lawnewz.com\/author\/chris-white\/\" rel=\"author\"><br \/>\n<\/a>LAW NEWZ<\/p>\n<div id=\"post-body\">\n<p>The Department of Justice on Tuesday released portions of search warrant obtained by the Federal Bureau of Investigation\u00a0after its agents found emails pertinent to the <strong>Hillary Clinton<\/strong> investigation during the Bureau\u2019s<strong> Anthony Weiner<\/strong> probe. \u00a0LawNewz.com obtained a copy of the warrant and posted a copy below.<\/p>\n<p>As <a href=\"http:\/\/lawnewz.com\/high-profile\/breaking-judge-orders-fbi-to-partially-unseal-warrant-used-to-get-clinton-docs-found-in-weiner-probe\/\" target=\"_blank\"><em>LawNewz.com\u00a0<\/em>reported on Monday<\/a>, a federal judge ordered the release of the materials after high-profile, Los Angeles attorney\u00a0<strong>E. Randol Schoenberg<\/strong> filed a Freedom of Information Act that\u00a0demanded the release of the materials.<\/p>\n<p>\u201cI see nothing at all in the search warrant application that would give rise to probable cause, nothing that would make anyone suspect that there was anything on the laptop beyond what the FBI had already searched and determined not to be evidence of a crime, nothing to suggest that there would be anything other than routine correspondence between Secretary Clinton and her longtime aide Huma Abedin,\u201d Schoenberg said in an email response to\u00a0<em>LawNewz.com<\/em> after reviewing the warrant.<\/p>\n<p>Here are some of the highlights of the heavily redacted FBI Agent\u2019s Search Warrant\u2019s Application:<\/p>\n<ul>\n<li>In the process of searching the computer belonging to an unidentified individual (reported in the media to Anthony Weiner and called \u201cSubject Laptop\u201d in the affidavit, agents \u201cobserved non-content header information indicating thousands of emails (redacted) resided on the Subject Laptop.\u201d<\/li>\n<li>The non-content header information indicated the Subject Laptop included \u201cemails sent and\/or received by (redacted) and at a (redacted) email account appearing to belong to (redacted) as well as correspondence between one or both of these accounts and State Department email accounts during and around (redacted).<\/li>\n<li>The FBI investigation into Clinton\u2019s improper handling, storage and transmission of classified information on unclassified email systems \u201cestablished that emails containing containing classified information were transmitted through multiple . . . accounts used by [all names redacted].\u201d<\/li>\n<li>The Agent believed there was \u201cprobable cause to believe that the Subject Laptop contain[ed] evidence, contraband, fruits, and\/or other items illegally possessed in violation of 18 \u00a0U.S.C. \u00a7793(e) and (f).\u201d \u00a0The inclusion of subsection (e) of \u00a7793 is interesting because that requires a \u201cwillful\u201d act as opposed to the much discussed, but rarely used, \u00a7793(f) that only requires \u201cgross negligence.\u201d<\/li>\n<li>Paragraph 26 of the FBI Agent\u2019s affidavit gets to the heart of the Bureau\u2019s probable cause argument.<\/li>\n<\/ul>\n<p>In that paragraph, the Agent states, part:<\/p>\n<blockquote><p>Given the information indicating [the presence of] thousands of . . . emails located on the Subject Laptop \u2014 including . . . the regular correspondence between (redacted) and [Hillary] Clinton, there is probable cause that Subject Laptop contains correspondence between (redacted) and Clinton (lengthy redaction).\u201d<\/p><\/blockquote>\n<p>Paragraph 26 continues, part:<\/p>\n<blockquote><p>Because it has been determined . . . that many emails were exchanged . . .
