{"id":52690,"date":"2016-10-18T06:44:43","date_gmt":"2016-10-18T10:44:43","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=52690"},"modified":"2016-10-18T06:44:43","modified_gmt":"2016-10-18T10:44:43","slug":"house-oversight-committee-calls-for-immediate-removal-of-under-secretary-of-state-patrick-kennedy","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=52690","title":{"rendered":"House Oversight Committee Calls for Immediate Removal of Under Secretary of State Patrick Kennedy"},"content":{"rendered":"<h1>PRESS RELEASE<\/h1>\n<h2>CHAFFETZ, NUNES STATEMENT ON NEW FBI FILES FROM CLINTON INVESTIGATION<\/h2>\n<p><strong>PUBLISHED:<\/strong> OCT 17, 2016<\/p>\n<p><em>Request Removal of Under Secretary Patrick Kennedy<\/em><!--more--><\/p>\n<p><strong>WASHINGTON, D.C.<\/strong>\u00a0\u2013\u00a0Today, House Oversight and Government Reform Committee Chairman Jason Chaffetz (R-UT) and House Intelligence Committee Chairman Devin Nunes (R-CA) released the following statement and summary findings after the Federal Bureau of Investigation (FBI) released additional files related to its investigation of Secretary Hillary Clinton\u2019s use of a private email server.<\/p>\n<p><strong><em>\u201cWe find Under Secretary Kennedy\u2019s actions extremely disturbing. Those who receive classified intelligence should not barter in it \u2013 that is reckless behavior with our nation\u2019s secrets. Someone who would try to\u00a0get classification markings doctored should not continue serving in the State Department or retain access to classified information. Therefore, President Obama and Secretary Kerry should immediately remove Under Secretary Kennedy pending a full investigation.\u201d<\/em><\/strong><\/p>\n<p>The Chairmen sent letters to U.S. State Department\u00a0<a href=\"http:\/\/oversight.house.gov\/wp-content\/uploads\/2016\/10\/2016-10-17-JEC-Nunes-to-Kerry-DOS-Kennedy-Clinton-Emails-1.pdf\">Secretary John Kerry<\/a>\u00a0and <a href=\"http:\/\/oversight.house.gov\/wp-content\/uploads\/2016\/10\/Letter-to-Linick.pdf\">Inspector General Steve Linick <\/a>requesting the immediate removal of Under Secretary Patrick Kennedy and an investigation into the misconduct.<\/p>\n<p>A summary of <a href=\"http:\/\/oversight.house.gov\/wp-content\/uploads\/2016\/10\/2016-10-17-Flash-Memo-Clinton-302s-FINAL.pdf\">key findings<\/a> from the documents is below.<\/p>\n<p><strong>The State Department put immense pressure on its own employees and on the FBI to determine none of the information in Secretary Clinton\u2019s emails was classified<em>.<\/em><\/strong><\/p>\n<ul>\n<li>In the spring of 2015, Under Secretary Patrick Kennedy contacted a senior FBI official to request the FBI reverse its finding that one of Secretary Clinton\u2019s Benghazi-related emails contained classified information. Kennedy allegedly assured the FBI official State would \u201carchive the document in the basement of [the Department] never to be seen again,\u201d withholding it from the public under Freedom of Information Act (FOIA) exception (b)(9), which relates to geological and geophysical information.<\/li>\n<\/ul>\n<ul>\n<li>In response, the FBI official proposed a \u201cquid pro quo\u201d to downgrade the classification if the State Department would support increasing FBI personnel into Iraq. A veteran diplomat like Kennedy should have been receptive to the FBI\u2019s personnel needs without resorting to a bargain that could threaten national security information. Due to the sensitive nature of the information, the classification was never ultimately downgraded.<\/li>\n<\/ul>\n<ul>\n<li>Thereafter, the State Department stopped conferring with the FBI on classification decisions related to Secretary Clinton\u2019s emails, and instead consulted with the Department of Justice to represent FBI equities.<\/li>\n<\/ul>\n<p><strong>Career State Department personnel who typically handle FOIA requests told the FBI the process for reviewing and releasing Secretary Clinton\u2019s emails was highly unusual, coordinated through the Office of Legislative Affairs rather than the normal FOIA office, and that decisions were made far differently for these emails than for any other FOIA request<\/strong>.<\/p>\n<ul>\n<li>These career public servants, which normally process FOIA requests, considered it odd that a separate system was set up to review the Clinton emails, including bringing on Austin Evers and former IRS employee Kate Duval, both of whom had formerly worked at Williams &amp; Connolly \u2013 the very same law firm representing Secretary Clinton.<\/li>\n<\/ul>\n<ul>\n<li>The two Legislative Affairs attorneys met regularly with a group of senior State Department officials which the career personnel dubbed \u201cthe shadow government.\u201d The group included Secretary Kerry\u2019s Chief of Staff, Under Secretary for Management Patrick Kennedy, and others, who met to decide how to respond to Congressional and FOIA requests related to Secretary Clinton.<\/li>\n<\/ul>\n<ul>\n<li>Secretary Clinton has said her federal records were preserved throughout her tenure through the Department employees who received emails from her. Accordingly, the State Department sent a Department-wide request to produce to the FOIA office\u00a0any emails with Secretary Clinton. Yet when Secretary Clinton\u2019s lawyers produced a limited batch of emails, some of them\u00a0involved employees who claimed they had no emails with Secretary Clinton.
