In a\u00a0<a href=\"http:\/\/www.politico.com\/f\/?id=00000156-8cda-df7e-af77-9ddbfafa0002\">defense filing last week<\/a>, Saucier\u2019s attorney stated that Mr. Saucier simply wanted a record of his time on the sub in order to \u201cone day show his family and future children what he did while he was in the Navy.\u201d However, despite the fact that there was no ill intention, the retention of classified defense information is itself a violation of U.S. law and a felony.<\/p>\n<figure id=\"attachment_34556\" class=\"wp-caption alignright active\"><a href=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-34556 size-medium\" src=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download-300x163.jpeg\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" srcset=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download-300x163.jpeg 300w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download-768x416.jpeg 768w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download-1024x555.jpeg 1024w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download-367x200.jpeg 367w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/download.jpeg 1160w\" alt=\"download\" width=\"300\" height=\"163\" \/><\/a><figcaption class=\"wp-caption-text\">Petty Officer First Class Kristian Saucier (US District Court<br \/>\nFor Connecticut)<\/figcaption><\/figure>\n<p>Right about the same time, then-Secretary of State Hillary Clinton, by her own admission, used her private email address, housed on a private server located in her Chappaqua, N.Y., home, to perform State Department business. Because she didn\u2019t use the government system, the department didn\u2019t have her emails on hand when the House Select Committee on Benghazi asked to see them. According to Politifact.com in 2014, Clinton\u2019s lawyers combed through the private server and turned over about 30,000 work-related emails to the State Department and deleted the rest, which Clinton said were about personal matters.<\/p>\n<p>On July 5, 2016, FBI Director James Comey recommended no criminal charges against Hillary Clinton for her mishandling of classified information while she was secretary of state. One of the primary reasons given on why the Justice Department will not prosecute Secretary Clinton is that they found no evidence that Clinton \u201cintended to be disloyal to the United States or that she intended to obstruct justice.\u201d<\/p>\n<p><iframe loading=\"lazy\" id=\"nyt_video_player\" title=\"New York Times Video - Embed Player\" src=\"http:\/\/static01.nyt.com\/video\/players\/offsite\/index.html?videoId=100000004511181\" width=\"480\" height=\"321\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/p>\n<p>A very dangerous precedent has been set. Using the Justice Department\u2019s own argument, we can expect to see a number of cases citing the FBI\u2019s recent recommendation not to charge Hillary Clinton as a defense against felonies like this.<\/p>\n<p>And in fact, Petty Officer First Class Kristian Saucier pled guilty to one felony charge of \u201cretaining national defense information without permission.\u201d However, he is asking for probation without jail time in lieu of the standard 63-78 month prison term. The reason? Just like Hillary, and citing the FBI\u2019s decision, he states that he had no intention to be disloyal to the United States.<\/p>\n<figure id=\"attachment_34555\" class=\"wp-caption alignleft active\"><a href=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-34555 size-medium\" src=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208-204x300.jpg\" sizes=\"auto, (max-width: 204px) 100vw, 204px\" srcset=\"http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208-204x300.jpg 204w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208-768x1130.jpg 768w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208-696x1024.jpg 696w, http:\/\/inmilitary.com\/wp-content\/uploads\/2016\/08\/GettyImages-72271208.jpg 1392w\" alt=\"GettyImages-72271208\" width=\"204\" height=\"300\" \/><\/a><figcaption class=\"wp-caption-text\">The attack submarine USS Alexandria<br \/>\npasses through the Suez Canal<\/figcaption><\/figure>\n<p>In our justice system, \u201cciting\u201d other courts\u2019 opinions are standard practice and used quite often in criminal cases like this and social matters like Roe v. Wade. If this sailor\u2019s defense holds up, we may be in a new era of classified information management.<\/p>\n<p>In our system of checks and balances, a system that was carefully crafted by the Founders, accountability must be maintained, no matter what the position an individual holds within the government. If any one individual is above the law, then the whole system breaks down.<\/p>\n<p>Let\u2019s work together as a nation to ensure that our system\u2019s integrity is maintained. Violations of the law should be prosecuted. If a particular law is found to be antiquated or faulty, we have a system in place to change the law. Until then, we must enforce with no differentiation between the president and a citizen.<\/p>\n<p>What do you think?
