{"id":40306,"date":"2016-06-14T17:38:01","date_gmt":"2016-06-14T21:38:01","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=40306"},"modified":"2016-06-14T17:39:46","modified_gmt":"2016-06-14T21:39:46","slug":"40306","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=40306","title":{"rendered":"PLANNED PARENTHOOD: Marketing Arm of America&#8217;s Abortion Factory"},"content":{"rendered":"<h1 class=\"posttitle\">JUDGE TAKES ACTION IN PLANNED PARENTHOOD VIDEOS CASE<\/h1>\n<h2 class=\"deck\">Undercover investigation revealed abortionists&#8217; trade in unborn-baby parts<\/h2>\n<p><!--more--><\/p>\n<p>by Bob Unruh<br \/>\nWND.com<\/p>\n<div id=\"attachment_40307\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/06\/DavidDaleiden.png\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-40307\" class=\"size-full wp-image-40307\" src=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/06\/DavidDaleiden.png\" alt=\"David Daleiden\" width=\"600\" height=\"302\" srcset=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/06\/DavidDaleiden.png 600w, https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2016\/06\/DavidDaleiden-300x151.png 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-40307\" class=\"wp-caption-text\">David Daleiden<\/p><\/div>\n<p>A judge in Texas has dismissed one of the counts a grand jury had released against David Daleiden, the organizer of the Center for Medical Progress which last year produced a series of undercover videos revealing Planned Parenthood\u2019s trade in unborn-baby parts.<\/p>\n<p>The order from a judge in Harris County, Diane Bull, ordered dismissed a claim that Daleiden violated a state prohibition on unborn-baby parts trade when he asked questions and described himself as a procurer of body parts in order to obtain statements from Planned Parenthood officials.<\/p>\n<p>Various Planned Parenthood officials were caught on video explaining how they could adjust abortion procedures so as not to \u201ccrush that part,\u201d as well as discussing how their compensation for organs could be increased. One executive told the undercover video investigators, \u201cI want a Lamborghini.\u201d<\/p>\n<p>But federal law disallows changing abortion procedures to scavenge organs and prevents any profit in such transactions.<\/p>\n<p>The judge\u2019s order dismissing the count on Tuesday pointed out that the state law regarding the transfer of organs has an exception, and the prosecutor in the Daleiden case failed to address it.<\/p>\n<p>\u201cThe prosecuting attorney must negate the existence of an exception in the indictment and prove beyond a reasonable doubt that the defendant or defendant\u2019s conduct does not fall within the exception,\u201d she wrote.<\/p>\n<p>The prosecutor\u2019s failure means the indictment is void, and must be dismissed, she wrote.<\/p>\n<p>Daleiden has maintained that he followed applicable laws for investigative journalism in the course of the undercover investigation of Planned Parenthood, but he still faces a count of using a false ID to obtain the information.<\/p>\n<p>In a <a href=\"http:\/\/www.centerformedicalprogress.org\/2016\/06\/statement-on-the-dismissal-of-tx-indictment-against-david-daleiden\/\">statement posted online,<\/a> CMP said, \u201cJudge Diane Bull\u2019s swift dismissal of the bogus charge against CMP founder David Daleiden of trafficking human organs is the latest confirmation that the indictments from a runaway grand jury in Houston were a politically motivated sham all along.<\/p>\n<p>\u201cIn finding that the indictment was void on its face, Judge Bull\u2019s ruling directly contradicts the district attorney\u2019s argument that the indictment was valid despite the DA\u2019s collusion with Planned Parenthood. The dismissal of the first indictment today sends a strong message to Planned Parenthood and their political cronies that colluding to suppress the First Amendment rights of citizen journalists will never work.<\/p>\n<p>\u201cThe Center for Medical Progress follows all applicable laws in the course of its investigative journalism work and as more details about Planned Parenthood\u2019s contracts for aborted baby parts come to light, it\u2019s clear that Planned Parenthood and their business partners like StemExpress are the ones who are guilty of trafficking in human body parts.\u201d<\/p>\n<p>The videos have prompted a number of states to defund Planned Parenthood and several congressional investigations have begun into the organization that gets half a billion dollars a year from U.S. taxpayers. One conclusion already reached <a href=\"http:\/\/www.wnd.com\/2016\/04\/u-s-house-docs-profits-from-baby-body-parts-real\/\">under just one of the investigations was that there actually were profits in the baby body parts trade.<\/a><\/p>\n<p><a href=\"http:\/\/wnd.com\/2016\/04\/planned-parenthood-linked-district-attorney-now-in-hot-seat\/\">WND reported earlier<\/a> on a multitude of other questions also raised about the indictment in Texas.<\/p>\n<p>Daleiden and an associate were indicted by a grand jury assembled by <a href=\"http:\/\/app.dao.hctx.net\/OurOffice\/Contacts.aspx\">Harris County prosecutor Devon Anderson,<\/a> who has financial ties to a lawyer representing abortionists.<\/p>\n<p><a href=\"http:\/\/wnd.com\/2016\/01\/pro-lifers-demand-untainted-planned-parenthood-grand-jury\/\">At the time, officials with Operation Rescue,<\/a> another cutting edge pro-life organization like Daleiden\u2019s Center for Medical Progress, called for a new \u201cuntainted\u201d grand jury.<\/p>\n<p><a href=\"http:\/\/wnd.com\/?p=2875504\">Anderson\u2019s grand jury had indicted Daleiden<\/a> and Sandra Merritt after they posed as executives of a fake biomedical research company to capture with a hidden camera Planned Parenthood doctors and clinic managers discussing the harvesting of fetal tissue for profit.<\/p>\n<p>Operation Rescue said the charges against Daleiden and Merritt need to be dropped or a special prosecutor \u201cin no way affiliated with Devon Anderson, the Harris County district attorney\u2019s office or Chip Lewis\u201d needs to be appointed.<\/p>\n<p>OR reported its information \u201cindicates the grand jury indictments against David Daleiden and Sandra Merritt were likely in retaliation against Operation Rescue for filing a complaint against Houston abortionist Douglas Karpen, which led to a grand investigation of him in 2013.\u201d<\/p>\n<p>OR, whose chief is on the board of the CMP,\u00a0explained it filed a 2013 complaint that resulted in a grand-jury investigation of Karpen, who was accused by former co-workers of murdering babies born alive during shoddy abortions.<\/p>\n<p>\u201cChip Lewis, Karpen\u2019s attorney, falsely accused Operation Rescue of paying three former Karpen employees to testify against him and of \u2018doctoring\u2019 grisly photographs of babies Karpen had allegedly murdered, according to witnesses,\u201d OR said.<\/p>\n<p>\u201cLewis threatened Operation Rescue after no true bill was returned against Karpen. Lewis told the Houston Chronicle, \u2018Those responsible for bringing these wholly unfounded allegations against Dr. Karpen will be held responsible for their crimes.\u2019 He further threatened an investigation of Operation Rescue, which never materialized.\u201d<\/p>\n<p>It is Lewis, OR reported, who \u201chas tight connections to District Attorney Devon Anderson.\u201d<\/p>\n<p>\u201cHe is a long time personal friend of hers and her now deceased husband, former D.A. Mike Anderson, and is the largest political donor to the Anderson family. It could be assumed that Anderson owes Lewis for his friendship and political favors.\u201d<\/p>\n<p>Further, Planned Parenthood lawyer Josh Schaffer \u201cstated that during the grand jury proceedings, he and prosecutors maintained a \u2018dialogue \u2026 about the details of the case, and kept that going through,&#8217;\u201d court records reveal.<\/p>\n<p>\u201cTo further demonstrate collusion with the pro-abortion lawyers, an attorney for the National Abortion Foundation, Mr. Derek Foran, announced to the world via The New York Times that he had insider information and \u2018learned about the indictments in Texas about a half hour before they were publicly announced,&#8217;\u201d records state.<\/p>\n<p>The submission also explains Anderson\u2019s grand jury violate a variety of procedural rules, leaving the indictment invalid.<\/p>\n<p>Among the offenses committed against Daleiden?<\/p>\n<p>\u201cIt is well settled that no person may disclose the existence of an indictment as it is to be kept secret until the defendant is in custody or has been released on bond\u2026\u201d<\/p>\n<p>The grand jury also was without \u201cproper authority\u201d so the charge \u201cmust be quashed,\u201d the filing explains.<\/p>\n<p>\u201cFurthermore, the prosecutors have systematically leaked grand jury proceedings to unauthorized persons. There is no justifiable basis for this conduct and granting this motion to quash the indictments is the only appropriate remedy,\u201d it said.<\/p>\n<p>A spokesman in <a href=\"http:\/\/app.dao.hctx.net\/\">Anderson\u2019s office<\/a> confirmed to WND she was not taking questions on the issue, and he submitted a statement she had prepared: \u201cThese matters will be thoroughly reviewed by a judge and jury. I am confident that the actions of the DA\u2019s office in this case will withstand any scrutiny.\u201d<\/p>\n<p>OR reported it fought with Anderson over an investigation into abortionist Douglas Karpen several years ago. He never was charged, despite \u201cseveral eyewitnesses and photographs of babies who were said to have been born alive and murdered by slashing their necks and twisting their heads nearly off,\u201d OR officials said.<\/p>\n<p>Cheryl Sullenger of OR reported Anderson is well-known to be a close friend of Karpen\u2019s attorney, Chip Lewis, and after Anderson\u2019s grand jury \u201cno-billed\u201d Karpen, Lewis donated $25,000 to Anderson\u2019s political campaigns.<\/p>\n<p>Further, one of Anderson\u2019s staff members is on the board of the local abortion organization.<\/p>\n<p><a href=\"http:\/\/wnd.com\/?p=2880924\">WND reported <\/a>Rush Limbaugh described the Texas indictments as a \u201crogue\u201d prosecutor working with a \u201cpro-abortion\u201d staffer inside his own office.<\/p>\n<p>\u201cSo all that has to happen is that your rogue prosecutor, working in concert with your pro-abortion activist in the DA\u2019s office, get[s] in the grand jury room and start[s] explaining all this to the grand jury, which is made up of your average Hillary voter, for all we know,\u201d he said on Tuesday. \u201cAnd you start explaining what really went on here.
