{"id":37375,"date":"2016-05-06T09:20:37","date_gmt":"2016-05-06T13:20:37","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=37375"},"modified":"2016-05-06T09:20:37","modified_gmt":"2016-05-06T13:20:37","slug":"federal-judge-may-order-hillary-clinton-to-testify-in-ongoing-email-controversy","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=37375","title":{"rendered":"Federal Judge May Order Hillary Clinton To Testify In Ongoing Email Controversy"},"content":{"rendered":"<h2 class=\"headline__subtitle\">The move \u201cmay be necessary\u201d to determine whether the email was set up to circumvent freedom of information laws.<\/h2>\n<p><!--more--><\/p>\n<p>Cristian Farias<br \/>\nLegal Affairs Reporter, The Huffington Post<\/p>\n<div class=\"top-media\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;top_media&quot;}}\">\n<div class=\"top-media--image image\">\n<p><span class=\"share-bar-image-wrapper\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_image&quot;}}\"><img decoding=\"async\" class=\"image__src js-top-media-image\" src=\"http:\/\/img.huffingtonpost.com\/asset\/scalefit_630_noupscale\/572a94e7130000290038093b.jpeg\" \/><\/span><\/p>\n<div class=\"image__credit js-image-credit\">JIM YOUNG \/ REUTERS<\/div>\n<div class=\"image__caption js-image-caption\">The Hillary Clinton email saga is far from over.<\/div>\n<\/div>\n<\/div>\n<div class=\"content-list-component text\">\n<p>A federal judge on Wednesday signaled that he may be willing to order Hillary Clinton to testify about the decision to conduct official business on a private email server while she served as secretary of state.<\/p>\n<p>U.S. District Judge Emmet Sullivan said in an order <a href=\"http:\/\/pdfserver.amlaw.com\/nlj\/NLJ%205-4-16%20clinton%20emails%20depos.pdf\" target=\"_blank\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:0}}\">made public<\/a> Wednesday that it \u201cmay be necessary\u201d for Clinton to be deposed in an ongoing Freedom of Information Act lawsuit seeking unrelated employment records for one of her closest advisers while she was at the Department of State.<\/p>\n<p>The judge said \u201cquestions surrounding the creation, purpose and use of the<span class=\"skimlinks-unlinked\">clintonemail.com<\/span> server must be explored\u201d so that he may assess whether it was put in place to circumvent federal open-records laws.<\/p>\n<p>Prior to the revelations that the email server existed, Judicial Watch, a conservative watchdog group, sued the Department of State to seek disclosure of the employment records of Huma Abedin, Clinton\u2019s deputy chief of staff,\u00a0with an eye toward unearthing potential conflicts with private sector work Abedin engaged in while at the department.<\/p>\n<p>Once some of the records were produced, the parties agreed to dismiss the case in early 2014. But when The New York Times <a href=\"http:\/\/www.nytimes.com\/2015\/03\/03\/us\/politics\/hillary-clintons-use-of-private-email-at-state-department-raises-flags.html?_r=0\" target=\"_blank\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:1}}\">reported on the existence of the email server<\/a> last March,\u00a0the watchdog group went back to court and later alleged that Clinton and State \u201csought to deliberately thwart\u201d the Freedom of Information Act with the setup of the server.<\/p>\n<p>In Wednesday\u2019s order, Sullivan seemed to cabin the implications of the case, noting that it involves the\u00a0\u201cnarrow legal question\u201d of whether State acted in good faith when it produced the records under the original request.<\/p>\n<p>\u201cAlthough the State Department has taken some action to recover federal records related to this case,\u201d Sullivan wrote, \u201cthose efforts do not resolve the question of whether the agency\u2019s search in response to Judicial Watch\u2019s FOIA request was reasonable.\u201d<\/p>\n<p>To get to the bottom of that legal question, Sullivan allowed lawyers for Judicial Watch to seek testimony from Abedin and Cheryl Mills, Clinton\u2019s chief of staff in her four years at State, as well as from other State employees who were involved in the deliberations surrounding the setup of the email system.<\/p>\n<p>Once that round of depositions and other evidence is collected in the case, for which the court gave an eight-week timeline, Sullivan said the lawyers can ask him for \u201cpermission\u201d to also seek Clinton\u2019s testimony.<\/p>\n<p>This, Sullivan wrote, would \u201cenable the Court to resolve, as a matter of law, the adequacy of the State Department\u2019s search of relevant records\u201d related to the initial Abedin inquiry.<\/p>\n<p>As a result of a <a href=\"http:\/\/news.vice.com\/article\/judge-orders-state-department-to-release-clinton-emails-on-rolling-basis\" target=\"_blank\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:2}}\">separate freedom of information lawsuit<\/a> brought by Vice News, the State Department has released tens of thousands of unclassified emails from the server on a rolling basis. That process hit <a href=\"http:\/\/www.huffingtonpost.com\/entry\/hillary-clinton-emails-release-delays_us_56ba6904e4b08ffac1231cd5\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:3}}\">some snags<\/a>,\u00a0but it was complete as of Feb. 29.<\/p>\n<p>Through it all, Clinton has insisted that she\u00a0<a href=\"http:\/\/www.huffingtonpost.com\/entry\/hillary-clinton-private-email_us_5692cdbce4b0a2b6fb708334\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:4}}\">did not personally send any emails with classified information<\/a>\u00a0during her tenure at State.<\/p>\n<p>All of the above is wholly unrelated to a separate FBI probe in the controversy.
