{"id":37121,"date":"2016-05-03T12:29:02","date_gmt":"2016-05-03T16:29:02","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=37121"},"modified":"2016-05-03T12:29:52","modified_gmt":"2016-05-03T16:29:52","slug":"37121","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=37121","title":{"rendered":"Scalia\u2019s Dead, Now Supreme Court Grants FBI Remote Access to ANY Computer in the US"},"content":{"rendered":"<p><!--more-->by Melissa Dykes<\/p>\n<p><a href=\"http:\/\/i0.wp.com\/www.thedailysheeple.com\/wp-content\/uploads\/2016\/02\/scaliasm.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-128625 aligncenter\" src=\"http:\/\/i0.wp.com\/www.thedailysheeple.com\/wp-content\/uploads\/2016\/02\/scaliasm.jpg?resize=500%2C323\" alt=\"scaliasm\" width=\"500\" height=\"323\" \/><\/a><\/p>\n<p><a href=\"http:\/\/www.dcclothesline.com\/2016\/02\/16\/the-sudden-death-of-justice-scalia-and-what-it-means-for-america\/\" target=\"_blank\">Justice Scalia<\/a>, love him or hate him, was perhaps the most staunchly Constitutional Supreme Court justice we had.<span id=\"more-59687\"><\/span><\/p>\n<p>Now <a href=\"http:\/\/www.dcclothesline.com\/2016\/02\/18\/obama-is-skipping-scalias-funeral-too-busy-picking-out-scalias-replacement\/\" target=\"_blank\">he\u2019s dead<\/a> and not even two months later, the Supreme Court has approved new rules that would allow the FBI to not only hack any computer in the U.S., but around the globe.<em>Legally.<\/em><\/p>\n<p>In an April 28th <a href=\"http:\/\/www.supremecourt.gov\/orders\/courtorders\/frcr16_8mad.pdf\" target=\"_blank\">letter to Congress<\/a>, a change to Federal Rule of Criminal Procedure 41 was approved:<\/p>\n<blockquote><p>\u201cA magistrate judge with authority in any district where activities related to a crime may have occurred has authority to issue a warrant to use remote access to search electronic storage media and to seize or copy electronically stored information located within or outside that district if: (A) the district where the media or information is located has been concealed through technological means; or (B) in an investigation of a violation of 18 U.S.C. \u00a7 1030(a)(5), the media are protected computers that have been damaged without authorization and are located in five or more districts.\u201d<\/p><\/blockquote>\n<p>Warrants to gain remote access \u2014 in other words, government hacking \u2014 to include computers that have been \u201cconcealed through technological means\u201d such as TOR technology.<\/p>\n<p>And it isn\u2019t just limited to crime suspects who they get a warrant against (via <a href=\"http:\/\/www.rt.com\/usa\/341405-fbi-expanded-hacking-power-courts\/\" target=\"_blank\">RT<\/a>):<\/p>\n<blockquote><p>Currently, magistrate judges cannot issue warrants for \u201cremote searches\u201d to the FBI if law enforcement doesn\u2019t know where a computer in question is physically located, since its location could potentially be outside of the court\u2019s jurisdiction.<\/p>\n<p>Not only does the new rule change that, <strong>it also could allow the FBI to gain access to computers that have been already hacked by malicious software,<\/strong> <strong>meaning that victims of cyberattacks could see their computers searched by the government.<\/strong> <strong>If a computer is suspected to be part of compromised network, that network could also be searched.<\/strong> If a computer is ultimately located overseas but hidden via Tor, then authorities may potentially be able to hack into it as well.<\/p><\/blockquote>\n<p>Warrants for \u201cremote government searches\u201d of any computer\u2026 <em>\u201cLegally\u201d.<\/em><\/p>\n<p>You know who might\u2019ve had a problem with that? <a href=\"http:\/\/www.dcclothesline.com\/2016\/02\/16\/who-dies-with-a-pillow-over-their-head-former-army-intel-officer-suspects-foul-play-in-death-of-scalia\/\" target=\"_blank\">Justice Scalia<\/a>.<\/p>\n<p>Wonder how long it\u2019ll be until we get to <em><a href=\"http:\/\/www.amazon.com\/gp\/product\/B00A2FSXHK?ie=UTF8&amp;linkCode=as2&amp;camp=1634&amp;creative=6738&amp;tag=sheeple-embd-20&amp;creativeASIN=B00A2FSXHK\" target=\"_blank\" rel=\"nofollow\">Minority Report<\/a><\/em>-style pre-crime?<\/p>\n<p>Congress has until December to stop this, but they can also tweak it or approve it\u2026 considering they have a nine percent approval rating, I\u2019m not holding my breath.<\/p>\n<p>But hey, at least one whole Senator is bothering to pretend to care:<\/p>\n<blockquote><p>However, not everyone is buying the Justice Department\u2019s argument. Senator Ron Wyden (D-Oregon) questioned the wisdom of the changes to Rule 41, adding that he will ask the government to detail its hacking process.
