{"id":27163,"date":"2015-12-13T15:34:48","date_gmt":"2015-12-13T19:34:48","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=27163"},"modified":"2015-12-14T19:17:45","modified_gmt":"2015-12-14T23:17:45","slug":"owes-taxes-lose-your-passport","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=27163","title":{"rendered":"Owes taxes, lose your passport"},"content":{"rendered":"<h1 class=\"entry-title\">New law HR 22: If you owe taxes, your passport will be\u00a0confiscated<\/h1>\n<p><!--more--><\/p>\n<p><span class=\"sep\">by<\/span> <span class=\"author vcard\">Dr. Eowyn<br \/>\nFellowship of the Minds<\/span><\/p>\n<p>In the former Soviet Union and Maoist China, citizens were prevented from free travel within their countries, as well as the freedom to leave\u00a0their countries.<\/p>\n<p>On December 4, 2015, while the media whipped Americans into a frenzy over the San Bernardino mass shooting of 2 days ago, Obama quietly signed into law H.R. 22, a bill that would make the former Soviet Union and every totalitarian state proud.<\/p>\n<p><strong><a href=\"http:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/22\/text\" target=\"_blank\">H.R. 22: FAST Act<\/a><\/strong>\u00a0(also called Hire More Heroes Act of 2015) renders\u00a0<strong>Americans whom the IRS maintains to have \u201cseriously delinquent tax debt\u201d no longer free to leave or travel outside the United States.\u00a0<\/strong><\/p>\n<p><a href=\"http:\/\/fellowshipofminds.files.wordpress.com\/2015\/12\/devouring-monster.jpg\" rel=\"attachment wp-att-126288\"><img decoding=\"async\" class=\"aligncenter size-full wp-image-126288\" src=\"http:\/\/fellowshipofminds.files.wordpress.com\/2015\/12\/devouring-monster.jpg?w=500\" alt=\"devouring monster\" \/><\/a><\/p>\n<p>As <a href=\"http:\/\/www.sovereignman.com\/trends\/check-out-the-new-law-that-obama-quietly-signed-over-the-weekend-18323\/\" target=\"_blank\">Simon Black<\/a>, founder of SovereignMan, points out:<\/p>\n<blockquote><p>A bankrupt government has just awarded itself even more power to destroy people\u2019s freedom in the name of plundering wealth from the citizens.<\/p>\n<p>They made it happen quietly over a weekend when everyone was distracted with a violent shooting\u2026.<\/p>\n<p>Buried deep within its [HR22] 400+ pages is a provision giving the government the authority to revoke your passport if they believe in their sole discretion that you have \u201cseriously delinquent tax debt\u201d\u2026.<\/p>\n<p>So this provision is now officially law and will be formally codified in section 7345 of the Internal Revenue Code.<\/p>\n<p>There\u2019s no judge. No trial. It\u2019s a simple administrative procedure. Like that\u2026 poof\u2026 you can be stripped of your passport.<\/p><\/blockquote>\n<p><a href=\"http:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/22\/text\" target=\"_blank\">H.R. 22<\/a>,\u00a0Section 7345(a) states:<\/p>\n<blockquote><p><span class=\"lbexSectionLevelOLCnuclear\">In general<\/span>.\u2014If the Secretary receives certification by the Commissioner of Internal Revenue that an individual has a seriously delinquent tax debt, the Secretary shall transmit such certification to the Secretary of State for action with respect to <strong>denial, revocation, or limitation of a passport<\/strong> pursuant to section 32101 of the FAST Act.<\/p><\/blockquote>\n<p>H. R. 22, Section 32101(a) states that \u201cSubchapter D of <a href=\"http:\/\/uscode.house.gov\/quicksearch\/get.plx?title=26&amp;chapter=75\">chapter 75<\/a> of the Internal Revenue Code of 1986 is amended by adding at the end\u201d Section 7345 of H.R. 22.<\/p>\n<p>H.R. 22, <strong>Section 7345(b) defines \u201cseriously delinquent tax debt\u201d as <\/strong>\u201can unpaid, legally enforceable Federal tax liability of an individual\u201d which:<\/p>\n<ol>\n<li>has been assessed,<\/li>\n<li class=\"lbexIndentSubpar\">is greater than $50,000, and<\/li>\n<li class=\"lbexIndentSubpar\">with respect to which\u00a0a notice of lien has been filed and \u201ca levy is made pursuant to section 6331.\u201d<\/li>\n<\/ol>\n<p>Worse still is the fact that <strong>H.R. 22 includes a \u201cget out of jail free clause\u201d for government officials if they make a mistake in denying or revoking your passport.<\/strong>\u00a0<strong>Section 7345(e)(3)<\/strong> states that:<\/p>\n<blockquote><p>\u201cThe Secretary of the Treasury, the Secretary of State, and any of their designees shall not be liable to an individual for any action with respect to a certification by the Commissioner of Internal Revenue under section 7345. . .\u201d<\/p><\/blockquote>\n<p>That means the United States government can revoke your passport on the grounds that you are \u201cseriously\u201d delinquent in paying your taxes, and <strong>even if it turns out you had paid your taxes, you cannot hold accountable those officials who mistakenly had revoked your passport.<\/strong><\/p>\n<p>H.R. 22 was sponsored by Rep. Rodney Davis (R-IL), with 118 co-sponsors. The FAST Act became Public Law No: 114-94 on Dec. 4, 2015.<\/p>\n<p>Simon Black observes:<\/p>\n<blockquote><p>If you still think the government is there to protect and support you, it\u2019s time to take a hard look at reality\u2026.<\/p><\/blockquote>\n<blockquote><p>These people are flat broke. And you are nothing but a dairy cow to them, locked in a pasture to be milked dry as they slide further into bankruptcy.<\/p>\n<p>This is not some wild conspiracy theory.
