{"id":18470,"date":"2015-07-23T20:41:21","date_gmt":"2015-07-23T20:41:21","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=18470"},"modified":"2015-07-23T20:41:43","modified_gmt":"2015-07-23T20:41:43","slug":"eu-launches-anti-trust-case-against-top-hollywood-studios","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=18470","title":{"rendered":"EU Launches Anti-Trust Case Against Top Hollywood Studios"},"content":{"rendered":"<h1 class=\"entry-component__headline\">EU Opens Antitrust Case Against 6 Major US Movie Studios<\/h1>\n<p>By RAF CASERT<br \/>\nAP<\/p>\n<p>BRUSSELS \u2014 The European Union has launched an antitrust case against six major U.S. movie studios, including Disney and Warner Bros, and British satellite broadcaster Sky for restricting access across the 28-country bloc.<\/p>\n<p>The EU\u2019s executive Commission said Thursday it had sent a statement of objections to the companies regarding what it says are \u201ccontractual restrictions\u201d that prevent Sky offering its full service to consumers beyond Britain and Ireland.<\/p>\n<p>The companies mentioned in the statement are NBCUniversal, Paramount Pictures, Sony and Twentieth Century Fox as well as Disney, Warner Bros. and Sky UK.<br \/>\n<!--more--><br \/>\n\u201cEuropean consumers want to watch the pay-TV channels of their choice regardless of where they live or travel in the EU,\u201d EU Commissioner Margrethe Vestager said. \u201cOur investigation shows that they cannot do this today.\u201d<\/p>\n<p>Since the suspected restriction runs counter to one of the cornerstones of the European Union \u2014 the abolition of all impediment to trade within the EU\u2019s borders \u2014 the Sky UK case raises questions for other broadcasters across Europe.<\/p>\n<p>The Commission, which wields vast powers when it comes to antitrust and anticompetitive practices in the EU, confirmed it is also looking into similar cases including Canal Plus of France, Sky Italia of Italy, Germany\u2019s Sky Deutschland and DTS of Spain.<\/p>\n<p>\u201cWe continue to examine cross-border access to pay-TV services in these member states,\u201d said Commission spokesman Ricardo Cardoso.<\/p>\n<p>In a statement, Sky acknowledged receipt of the Commission\u2019s objections and said it will \u201crespond in due course.\u201d<\/p>\n<p>The Commission, which opened a probe into the seven companies and their territorial contracts in January 2014, found clauses requiring Sky to block access to films through its online or satellite pay-TV services to consumers outside Britain and Ireland \u2014 so-called \u201cgeo-blocking.\u201d<\/p>\n<p>It also said found that some contracts required studios to prevent their services being made available in the two countries to others than Sky \u2014 another potential restrictive practice.<\/p>\n<p>\u201cLicensing agreements between the major film studios and Sky UK do not allow consumers in other EU countries to access Sky\u2019s UK and Irish pay-TV services, via satellite or online,\u201d Vestager said. \u201cWe believe that this may be in breach of EU competition rules.\u201d<\/p>\n<p>The firms named now have the right to respond. There is no legal deadline for the Commission to complete antitrust inquiries.<\/p>\n<p>If the Commission decides that antitrust rules have been infringes, companies can be forced to pay a fine which can theoretically go as high 10 percent of overall annual turnover.<\/p>\n<p>___<\/p>\n<p>Jill Lawless contributed from London<\/p>\n<p>Copyright 2015 The Associated Press.
