{"id":14387,"date":"2015-04-23T14:50:58","date_gmt":"2015-04-23T14:50:58","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=14387"},"modified":"2015-04-23T14:53:44","modified_gmt":"2015-04-23T14:53:44","slug":"house-investigator-gowdy-stalls-benghazi-proceedings-why-is-secretary-clinton-not-being-held-in-contempt-for-server-scandal","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=14387","title":{"rendered":"House Investigator Gowdy Stalls Benghazi Proceedings:  Why is Secretary Clinton not being held in contempt for server scandal?"},"content":{"rendered":"<h1 class=\"posttitle\">GOWDY: HILLARY SERVER STONEWALL MAY BE IMPREGNABLE<\/h1>\n<p>Garth Grant<br \/>\nWND.com<\/p>\n<p><script src=\"http:\/\/player.ooyala.com\/iframe.js#ec=h5ajlvdDq_ehkuFTq6Hbzc3X6C8ZUeWQ&amp;pbid=29c9fd42b6564348812f1c7d4ff9252d\"><\/script><\/p>\n<p>WASHINGTON \u2013 Whether the public ever learns the truth about what happened in Benghazi may come down to a chess match between a pair of high-powered attorneys.<\/p>\n<p>David Kendall, the lawyer representing former Secretary of State Hillary Clinton, wrote a <a href=\"http:\/\/democrats.benghazi.house.gov\/sites\/democrats.benghazi.house.gov\/files\/documents\/2015_04_22_Kendall_to_Gowdy_re_Response_to_03-31-15_Letter.PDF\">letter<\/a>\u00a0on Wednesday to the Select Committee on Benghazi stating that she would not testify privately before the committee.<!--more--><\/p>\n<p>However, he did say Clinton would be willing to testify publicly.<\/p>\n<p>That would appear to be a win for committee chairman Rep. Trey Gowdy, R-S.C.<\/p>\n<p>But it was not.<\/p>\n<p>Clinton had already signaled a willingness to testify publicly back in November.<\/p>\n<p>But that was before news broke on March 2 that Clinton had kept all of her emails on a private server during her tenure as\u00a0secretary of state.<\/p>\n<p>Since then, Gowdy\u00a0has requested two interviews with Clinton: one in private, focusing on her email use, and a public hearing focusing specifically on Benghazi.<\/p>\n<p>Why private?<\/p>\n<div id=\"attachment_612531\" style=\"width: 331px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/www.wnd.com\/files\/2014\/01\/Hillary-Clinton-at-senate-0152.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-612531\" class=\"wp-image-612531\" src=\"http:\/\/www.wnd.com\/files\/2014\/01\/Hillary-Clinton-at-senate-0152-300x168.jpg\" alt=\"Secretary of State Hillary Clinton testifies before he Senate Foreign Relations Committee on Jan. 23, 2013\" width=\"321\" height=\"180\" \/><\/a><p id=\"caption-attachment-612531\" class=\"wp-caption-text\">Secretary of State Hillary Clinton testifies on Benghazi before the Senate on Jan. 23, 2013<\/p><\/div>\n<p>In his <a href=\"http:\/\/benghazi.house.gov\/news\/press-releases\/select-committee-formally-requests-secretary-clinton-interview-on-email\">letter to Kendall<\/a> on March 31, Gowdy wrote:<\/p>\n<p>\u201cThe Committee believes a transcribed interview would best protect Secretary Clinton\u2019s privacy, the security of the information queried, and the public\u2019s interest in ensuring this Committee has all information needed to accomplish the task set before it.<\/p>\n<p>\u201cOnce there is a reasonable assurance all documents in the Secretary\u2019s care, custody and control related to what happened before, during, and after the attacks in Benghazi have been shared with the Committee, we will be in a position to schedule her appearance in a public hearing to constructively discuss these topics.\u201d<\/p>\n<p>What Gowdy wanted was to get Clinton\u2019s private testimony on what was in her emails concerning Benghazi, research that information and then see if it could be confirmed or contradicted, then quiz her publicly on the deadly terrorist attack.<\/p>\n<p>But if Clinton were to merely testify about the emails in a public hearing, there would be no way to challenge whatever she might claim to be the truth.<\/p>\n<p>In a letter released Wednesday evening, Gowdy replied, \u201cI appreciate Mr. Kendall\u2019s timely response to our letter but respectfully disagree with his assertion former Secretary Clinton has answered all questions surrounding the unusual email arrangement she had with herself.\u201d<\/p>\n<p>Gowdy\u2019s main problem is that he does not know what he does not know.<\/p>\n<div id=\"attachment_823291\" style=\"width: 254px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/www.wnd.com\/files\/2014\/05\/GOWDY.png\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-823291\" class=\"wp-image-823291\" src=\"http:\/\/www.wnd.com\/files\/2014\/05\/GOWDY.png\" alt=\"Rep. Trey Gowdy, R-S.C.<\/p><\/div>\n<p>The State Department has released 30,490 pages of emails for review from the more than 60,000 emails in Clinton\u2019s account. But, as the <a href=\"http:\/\/www.nytimes.com\/2015\/03\/03\/us\/politics\/hillary-clintons-use-of-private-email-at-state-department-raises-flags.html\">New York Times<\/a> reported, it was a group of Clinton\u2019s advisers who decided which of her emails should be released.<\/p>\n<p>Additionally, Clinton has admitted she deleted 31,830 emails she claimed were private.<\/p>\n<p>So, unless Gowdy can get the email server itself, he has no idea what information Clinton may, or may not, be hiding about Benghazi, and what the full extent of her involvement may have been.<\/p>\n<p>And there\u2019s the rub.<\/p>\n<p>For those reading between the lines, it has become clear Gowdy has been signaling lately that his hands may be tied when it comes to obtaining Hillary Clinton\u2019s email server.<\/p>\n<p>Furthermore, the chairman is hinting his committee may not be able to bring the former secretary of state to account for whatever dark role she may have played in the Benghazi scandal.<\/p>\n<p>The insurmountable problem appears to be the inevitable stonewall that would be erected by Obama\u2019s Justice Department.<\/p>\n<p>But that does not mean all is lost.<\/p>\n<p>Gowdy does hold out hope that the court of public opinion can override an inability to bring the case to a court of law.<\/p>\n<p>That will be a formidable task.<\/p>\n<p>The congressman, a former federal prosecutor, presented the facts of the case in an <a href=\"http:\/\/www.foxnews.com\/on-air\/justice-jeanine\/index.html#\/v\/4184579817001\">interview with Fox News\u2019 Judge Jeanine Pirro<\/a> on Monday.<\/p>\n<p>She asked what everyone wants to know: Why can\u2019t his committee get Clinton\u2019s private email server?<\/p>\n<p>Gowdy explained that he has the power to subpoena people and documents but not things, under the rules guiding his committee.<\/p>\n<p>The House may eventually subpoena the server, but, he explained, \u201cthe power to subpoena is only as good as the power to compel.\u201d<\/p>\n<p>Meaning, Clinton may just choose to ignore the subpoena.<\/p>\n<p>You could then hold her in contempt, suggested Pirro.<\/p>\n<p>\u201cWell, what\u2019s happened in the past when we\u2019ve held people in contempt? It\u2019s referred to the U.S. Attorney in the District of Columbia. He won\u2019t even prosecute Lois Lerner, which is a pretty clear case to me. So, it\u2019s the limitations of the legislative branch.\u201d<\/p>\n<p>That analysis comports with what former federal prosecutor Andrew McCarthy wrote in <a href=\"http:\/\/www.nationalreview.com\/article\/415277\/dont-blame-gowdy-andrew-c-mccarthy\">National Review<\/a> in March.<\/p>\n<div id=\"attachment_670777\" style=\"width: 310px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/www.wnd.com\/files\/2014\/03\/lois-lerner2.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-670777\" class=\"wp-image-670777 size-medium\" src=\"http:\/\/www.wnd.com\/files\/2014\/03\/lois-lerner2-300x142.jpg\" alt=\"Former IRS tax-exempt chief Lois Lerner has refused to testify\" width=\"300\" height=\"142\" \/><\/a><p id=\"caption-attachment-670777\" class=\"wp-caption-text\">Former IRS tax-exempt division chief Lois Lerner was voted in contempt of Congress for refusing to testify<\/p><\/div>\n<p>McCarthy observed that Gowdy heads a <em>legislative<\/em> committee and, \u201cis powerless to obtain search warrants and coerce the physical surrender of evidence.\u201d<\/p>\n<p>That is because \u201cthe committee is not a prosecutor.\u201d<\/p>\n<p>McCarthy added, \u201cCongress has no power to seize the evidence the subpoena seeks or to indict the perjurious official. It is up to the executive branch to take such action.\u201d<\/p>\n<p>And Gowdy noted the executive branch under Obama has persistently been reluctant, to say the least, to take such actions.<\/p>\n<p>He remarked how, \u201c[W]ith Fast and Furious and the IRS and all these other investigations, we wind up in court and its three years before the judge decides to give us an answer and people have lost interest and their attention has moved onto something else.\u201d<\/p>\n<p>So he tried a different tack.<\/p>\n<p>Gowdy had given Clinton until May 1 to respond to his request she appear before the Benghazi committee in private.<\/p>\n<p>\u201cWhat I want is access to the information and the documents,\u201d he said. \u201cI don\u2019t want the legal drama. So, if I can be uncharacteristically courteous and give her an extra two weeks and get what I want, I would rather do that than the drama of a floor fight.\u201d<\/p>\n<p>Now that she has refused, it doesn\u2019t mean all is lost.<\/p>\n<p>The congressman believes he has a persuasive case, and if Clinton doesn\u2019t provide the server, she may end up losing in the court of public opinion, because people are watching closely.<\/p>\n<p>\u201cI think the American people are fully engaged because they have really high expectations of their public officials. And if we can carry the burden of persuasion, which is a pretty easy burden to carry, [then] the public and the media and Congress should have access to the entire public record of anyone who has been secretary of state, whether it\u2019s Secretary Clinton, Secretary Powell or Secretary Rice.\u201d<\/p>\n<p>And finally, Gowdy believes he has the most important fact of all on his side when it comes to the fate of Clinton\u2019s emails.<\/p>\n<p>\u201cThose documents belong to us, and she alone does not get to be the sole arbiter to determine what\u2019s public and what\u2019s personal.
