{"id":127111,"date":"2019-08-22T11:32:16","date_gmt":"2019-08-22T15:32:16","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=127111"},"modified":"2019-08-22T11:34:02","modified_gmt":"2019-08-22T15:34:02","slug":"the-u-s-criminal-injustice-system-politicized-beyond-recognition","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=127111","title":{"rendered":"The U.S. Criminal Injustice System: Politicized beyond recognition"},"content":{"rendered":"<h1 class=\"p1\" style=\"text-align: center;\"><strong><span class=\"s1\">The Politicization of Justice\u00a0<\/span><\/strong><\/h1>\n<p><!--more-->by Renee Parsons<\/p>\n<p class=\"p2\"><span class=\"s1\">The American criminal justice system has long been a sharp painful thorn in the nation\u2019s consciousness as if to remind us of a major flaw in the American way of life.<span class=\"Apple-converted-space\">\u00a0 <\/span>Mostly, that awareness has focused on the inequities of prosecution and sentencing between the privileged upper class elites, the have-nots of the blue-collar underclass and our nation\u2019s minorities.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Since 2016 the US Department of Justice (DOJ) has had an increased national<span class=\"Apple-converted-space\">\u00a0 <\/span>presence<span class=\"Apple-converted-space\">\u00a0 <\/span>initially as it related to the discredited Russiagate collusion campaign and now, as long-standing corruption within the DOJ and Federal Bureau of Investigation (<a href=\"https:\/\/www.rt.com\/usa\/176744-fbi-forensic-lab-review\/\"><span class=\"s2\">FBI<\/span><\/a>)<span class=\"Apple-converted-space\">\u00a0 <\/span>surfaces, the status quo can no longer be tolerated. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Only those with a childlike <a href=\"https:\/\/www.youtube.com\/watch?v=pXqSTOUwMPg&amp;feature=em-uploademail\"><span class=\"s2\">innocence<\/span><\/a> would be surprised by the sudden, untimely death of Jeffrey Epstein while <a href=\"https:\/\/www.msn.com\/en-us\/news\/us\/jeffrey-epstein-suicide-basic-facts-elude-investigators-5-days-later\/ar-AAFSAIA\"><span class=\"s2\">incarcerated i<\/span><\/a>n the US Federal prison system. Attorney General Bob Barr<span class=\"Apple-converted-space\">\u00a0 <\/span>described himself as \u2018<a href=\"https:\/\/fox4kc.com\/2019\/08\/10\/attorney-general-barr-appalled-over-jeffrey-epsteins-death-announces-justice-department-investigation\/\"><span class=\"s2\">appalled<\/span><\/a>\u2019 that the planet\u2019s most politically connected trafficker of adolescent female flesh had \u2018suicided\u2019 out.<span class=\"Apple-converted-space\">\u00a0 <\/span>Epstein was also reported to be a valuable Mossad asset who used his unique position to blackmail a multitude of unsuspecting elite schmucks. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">If Barr brings the same level of incredulity to the ongoing <a href=\"https:\/\/www.thenation.com\/article\/james-comeys-actions-place-him-in-the-worst-traditions-of-j-edgar-hoover\/\"><span class=\"s2\">systemic investigations<\/span><\/a> of the effort to disrupt the 2016 presidential campaign and to unseat a sitting US President, we might as well roll up the last copy of<span class=\"Apple-converted-space\">\u00a0 <\/span>the Constitution and use it for kindling. <span class=\"Apple-converted-space\">\u00a0 <\/span>Despite a <a href=\"https:\/\/theantimedia.com\/fbi-corruption-history-10-most-crooked-things\/\"><span class=\"s2\">history<\/span><\/a> of <a href=\"https:\/\/www.nytimes.com\/1999\/12\/09\/us\/memphis-jury-sees-conspiracy-in-martin-luther-king-s-killing.html\"><span class=\"s2\">prejudicial bias<\/span><\/a> and <a href=\"http:\/\/crimemagazine.com\/tainting-evidence-inside-scandals-fbi-crime-lab\"><span class=\"s2\">unethical<\/span><\/a> conduct that is incompatible with a free, open and democratic society, injustice including one\u2019s demise at the hands of the American criminal justice system is nothing new.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Whether Epstein was mortally wounded or is sunning himself on an Israeli beach leads to the same conclusion: <span class=\"Apple-converted-space\">\u00a0 <\/span>it can no longer be denied that corruption of the nation\u2019s law enforcement system is widespread (ie <a href=\"https:\/\/harvardlawreview.org\/2018\/06\/how-crime-pays-the-unconstitutionality-of-modern-civil-asset-forfeiture-as-a-tool-of-criminal-law-enforcement\/\"><span class=\"s2\">civil asset forfeiture<\/span><\/a>) as its top officials and many of its privileged Federal judges are implicated.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">While a Grand Jury Inquiry into 911 has been stalled by the US Attorney at the US Southern District since April, 2018, it is anticipated that the DOJ Inspector General\u2019s report on <a href=\"https:\/\/www.washingtonexaminer.com\/news\/lindsey-graham-says-horowitz-fisa-report-will-be-ugly-and-damning-for-doj\"><span class=\"s2\">FISA Court<\/span><\/a> abuses will detail systemic criminal behavior at the highest levels of government perhaps reaching into the Obama White House.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Which brings us to the presidential campaign of Sen. Kamala Harris as walking \u2013 talking proof of why, as a prosecutor, she should be ineligible for election to any position of public trust. There is little reason to believe that Harris is an aberration but rather the product of an odious infection that Alex Kozinski, Chief Judge of the Ninth Circuit Court of Appeals described as \u201c<i>an epidemic of prosecutorial misconduct<\/i>.\u201d<span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Considering its hallowed beginnings with the <a href=\"https:\/\/memory.loc.gov\/cgi-bin\/ampage?collId=llac&amp;fileName=002\/llac002.db&amp;recNum=481\"><span class=\"s2\">Judiciary Act of 1789<\/span><\/a> which established the <a href=\"https:\/\/www.loc.gov\/resource\/mgw2.022\/?sp=187&amp;st=text\"><span class=\"s2\">Supreme Court<\/span><\/a>, created the nation\u2019s<span class=\"Apple-converted-space\">\u00a0 <\/span>Federal Court system including the first US Attorneys and US Marshals and the first Circuit and District Courts, the nation\u2019s law enforcement and judicial institutions are deeply embedded in the Constitutional roots of the Country. The Act also created the office of the <a href=\"https:\/\/www.loc.gov\/resource\/mgw2.022\/?sp=177&amp;st=text\"><span class=\"s2\">Attorney General<\/span><\/a>. <span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">In particular, a <a href=\"https:\/\/www.roberthjackson.org\/speech-and-writing\/the-federal-prosecutor\/\"><span class=\"s2\">Federal Prosecutor<\/span><\/a> is an omnipotent, most powerful person in any legal proceeding and armed with an unlimited pot of taxpayer funds.<span class=\"Apple-converted-space\">\u00a0 <\/span>With high-profile prosecutions as plum assignments, many prosecutors cannot resist the grandstanding and opportunity for fame and glory. They are in total control of the Grand Jury process with unfettered discretion to run roughshod over any defendant. <span class=\"Apple-converted-space\">\u00a0 <\/span>Losing sight of the fact that they are officers of the Court, they are<span class=\"Apple-converted-space\">\u00a0 <\/span>untouchable as they possess a legal immunity from their own criminal misconduct.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">There is an outstanding opportunity for the American public to better understand the level of corruption at the DOJ with a Must Read<span class=\"Apple-converted-space\">\u00a0 <\/span>of<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/sidneypowell.com\/\"><span class=\"s2\">Sidney Powell<\/span><\/a><\/span><span class=\"s2\">\u2019s<\/span><span class=\"s1\"> \u201c<a href=\"https:\/\/www.amazon.com\/Licensed-Lie-Exposing-Corruption-Department\/dp\/1612541496\"><span class=\"s2\"><i>Licensed to Lie<\/i><\/span><\/a><i>: Exposing Corruption in the US Department of Justice.<\/i>\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>Powell\u2019s book reads like a political expose, leaving the reader profoundly disturbed and stunned by the level of unimpeded corruption in the absence of any checks and balances.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Reading more like a fast-paced crime novel with one tragic suicide and one suspected murder, all the indictments were based on fabricated criminal allegations, a unanimous Supreme Court reversal, repeated Constitutional <a href=\"https:\/\/caselaw.findlaw.com\/us-supreme-court\/373\/83.html\"><span class=\"s2\">violations<\/span><\/a> of withholding evidence (ie <a href=\"https:\/\/www.chamberslawfirmca.com\/what-is-the-brady-rule\/\"><span class=\"s2\">Brady Rule<\/span><\/a>)<span class=\"Apple-converted-space\">\u00a0 <\/span>as well as wrongful imprisonments \u2013 all conducted by the highest levels of the country\u2019s criminal justice system involving two US District Court Judges and the Fifth Circuit Court of Appeals.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">All defendants were initially found guilty only to have their convictions reversed on appeal with one still guilty of perjury\/obstruction and concluding with the politically-inspired prosecutorial promotions to increased positions of power and influence within the DOJ or the revolving door to some of the nation\u2019s million dollar law firms. <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The following summaries of the three cases outlined in Powell\u2019s book do not do justice to the complexity and divergence from the Rule of<span class=\"Apple-converted-space\">\u00a0 <\/span>Law as so effectively detailed in <i>Licensed to Lie:<\/i>\u00a0<\/span><\/p>\n<h3 class=\"p2\"><span class=\"s3\">Enron Task Force Targets Arthur Anderson<\/span><\/h3>\n<p class=\"p2\"><span class=\"s1\">In March, 2002 with the GW Bush Administration in office, the DOJ began their investigation into the Enron collapse by indicting Arthur Anderson, the country\u2019s leading accounting firm since 1913. <span class=\"Apple-converted-space\">\u00a0 <\/span>The entire company of AA was indicted rather than any single individuals responsible. <span class=\"Apple-converted-space\">\u00a0 <\/span>As the auditor representing Enron along with 2,300 other publicly traded companies, the immediate impact of the indictment forced Anderson to close its doors leaving its 85,000 worldwide employees unemployed.<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">One Enron witness who refused to testify and plead guilty was put in solitary confinement for months until he wilted and agreed to testify per DOJ\u2019s instructions.<span class=\"Apple-converted-space\">\u00a0 <\/span>District Court Judge Melinda Harmon was cooperative of the government\u2019s case amending jury instructions to lessen the prosecution burden to prove their case.<span class=\"Apple-converted-space\">\u00a0 <\/span>The jury found the company guilty with the conviction affirmed by the Fifth Circuit.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s3\">In 2005, the Supreme Court found<span class=\"Apple-converted-space\">\u00a0 <\/span>that AA had committed no criminal conduct and<\/span> <span class=\"s3\">unanimously reversed the conviction 9-0<\/span><span class=\"s1\">.<\/span><\/p>\n<h3 class=\"p4\"><span class=\"s3\">DOJ Enron Task Force Targets <a href=\"https:\/\/www.youtube.com\/watch?v=uTD1eG7MF5o&amp;t=1263s\"><span class=\"s2\">Four Merrill Lynch Executives<\/span><\/a><\/span><\/h3>\n<p class=\"p4\"><span class=\"s1\">In September, 2003, four Merrill Lynch executives were indicted under an \u2018<a href=\"https:\/\/www.reuters.com\/article\/us-enron-merrilllynch-fraud-idUSTRE55H41V20090618\"><span class=\"s2\">honest services<\/span><\/a>\u2019 charge for conspiring to defraud Enron of its CFO services even though no fraud was committed.<span class=\"Apple-converted-space\">\u00a0 <\/span>Defense Council Powell <\/span><span class=\"s3\">could find no precedent for<span class=\"Apple-converted-space\">\u00a0 <\/span>making the honest services claim a federal criminal offense<\/span><span class=\"s1\">.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">The basis for the allegation was a five-minute telephone conversation on December 23 regarding Enron \u2018s guarantee to Merrill that they would buy back some Nigerian barges.\u00a0<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">The Task Force assured Defense Counsel\u2019s repeated requests that no Brady evidence existed.<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201cCooperative\u201d prosecution witnesses included<span class=\"Apple-converted-space\">\u00a0 <\/span>Enron\u2019s CFO Barry Fastow who was <\/span><span class=\"s3\">the<\/span><span class=\"s1\"> criminal master-mind of multiple mega million dollar thefts as compared to the four Merrill defendants who took no money and received no benefits.<span class=\"Apple-converted-space\">\u00a0 <\/span>Fastow served less than five years in prison.<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">As the jury returned a guilty verdict, District Judge Ewing Werlien denied all defense motions as the Task Force requested <\/span><span class=\"s3\">immediate<\/span><span class=\"s1\"> incarceration forcing the defendants to report to prison that day. <span class=\"Apple-converted-space\">\u00a0 <\/span>The Task Force had requested a 24 year sentence although each received 3 -4 years <\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">Always at issue was whether the DOJ prosecutors abided by the <a href=\"https:\/\/www.law.cornell.edu\/wex\/brady_rule\"><span class=\"s2\">Brady Rule<\/span><\/a> which constitutionally requires the prosecution to provide the defense with all exculpatory evidence that might benefit the defense.<span class=\"Apple-converted-space\">\u00a0 <\/span>Six years later, as one of the four defendants was still in appeals court, the Task Force accidentally revealed their withholding of evidence from Defense Council that would have exonerated the Merrill Four six years earlier. <\/span><\/p>\n<h3 class=\"p4\"><span class=\"s3\">DOJ Prosecution of Sen. Ted Stevens (R-Alaska) <\/span><\/h3>\n<p class=\"p4\"><span class=\"s1\">In July of 2008, Sen. Ted Stevens (R-Alaska) was indicted by a federal grand jury for failure to report gifts related to a home renovation and was found guilty on October 27<\/span><span class=\"s4\"><sup>th<\/sup><\/span><span class=\"s1\">.<span class=\"Apple-converted-space\">\u00a0 <\/span>Less than a week later, Stevens, a forty-year member of the US Senate, lost his re-election bid which changed the balance of power in the Senate as Barack Obama was elected President and the Democrats assumed control of the Senate.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">Soon after, in a rare display of ethical and moral fortitude, an <a href=\"https:\/\/www.forbes.com\/sites\/harveysilverglate\/2013\/07\/31\/is-the-fbi-a-racketeering-organization\/#5094adec3f42\"><span class=\"s2\">FBI<\/span><\/a> whistleblower<span class=\"Apple-converted-space\">\u00a0 <\/span>revealed that the Task Force attorneys had <a href=\"http:\/\/www.prosecutorialaccountability.com\/defining-misconduct\/failure-to-disclose\/\"><span class=\"s2\">withheld<\/span><\/a> exculpatory evidence from the Stevens defense, again violating the Brady Rule.<span class=\"Apple-converted-space\">\u00a0 <\/span>Newly appointed Attorney General Eric Holder was forced to dismiss the charges against Stevens with District Judge Emmett Sullivan overturning the Stevens conviction and ultimately appointed a special investigator to review the DOJ\u2019s behavior. <span class=\"Apple-converted-space\">\u00a0 <\/span>The <a href=\"https:\/\/www.justice-integrity.org\/148-stevens-misconduct-report-targets-mid-level-doj-officials\"><span class=\"s2\">Schuelke Report<\/span><\/a> targeted mid level FBI attorneys while vindicating its top supervisors.<span class=\"Apple-converted-space\">\u00a0 <\/span>The suggestion that the Steven\u2019s indictment was ideologically driven remains a possibility. <\/span><\/p>\n<p class=\"p4\" style=\"text-align: center;\"><span class=\"s1\"><span class=\"Apple-converted-space\">\u00a0\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span>*<span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 <\/span>* <span class=\"Apple-converted-space\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/span>*<\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">It remains an imponderable curiosity as to how an incestuous group-think led to these stunning levels of abuse of political power. <span class=\"Apple-converted-space\">\u00a0 <\/span>Why would some of the highest ranking officials within the DOJ seemingly consciously destroy the Constitutional presumption of innocence; that is, that any citizen is innocent until proven guilty &#8211; even as the concept has been a political football since the 2016 election.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">On Federal matters, the burden is always on the government to prove their case \u201cbeyond a reasonable doubt\u201d and yet, the government never met that burden in all three of the cases cited above. <span class=\"Apple-converted-space\">\u00a0 <\/span>It is as if there was deliberate intent to devastate the reputation and integrity of the country\u2019s leading law enforcement agencies thereby destroying its ability to ever again function as a credible advocate on behalf of the Bill of Rights.\u00a0<\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">The term \u2018prosecutorial misconduct\u2019 does not adequately sum up the damage done to the thousands of lives affected in the three cases;<span class=\"Apple-converted-space\">\u00a0 <\/span>livelihoods ruined, financial instability and<span class=\"Apple-converted-space\">\u00a0 <\/span>physical<span class=\"Apple-converted-space\">\u00a0 <\/span>well-being destroyed due to an improper, excessive display of the politicization of justice.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p2\"><span class=\"s1\">What is equally astounding is that for the DOJ to have failed in all three cases with<span class=\"Apple-converted-space\">\u00a0 <\/span>prosecutorial misconduct, the unanimous Supreme Court reversal and repudiation of the Department\u2019s legal prowess, any one of these cases were sufficient to merit a Congressional oversight hearing including what disciplinary action had been taken.<span class=\"Apple-converted-space\">\u00a0 \u00a0<\/span><\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">In addition, while Powell\u2019s book should have been a NY Times best seller, that once authoritative<span class=\"Apple-converted-space\">\u00a0 <\/span>\u201cnewspaper of record\u201d<span class=\"Apple-converted-space\">\u00a0 <\/span>refused to<span class=\"Apple-converted-space\">\u00a0 <\/span>\u2018review\u2019 the book<span class=\"Apple-converted-space\">\u00a0 <\/span>just as the NY Post backed off a story when the DOJ refused to make comment and book distributors have been less than cooperative. <\/span><\/p>\n<p class=\"p4\"><span class=\"s1\">And lastly, given the multiple Brady Rule violations, Sen. Lisa Murkowski (R-Alaska) introduced the<span class=\"Apple-converted-space\">\u00a0 <\/span><a href=\"https:\/\/www.govtrack.us\/congress\/bills\/112\/s2197\/text\"><span class=\"s2\">\u201c Fairness in Disclosure of Evidence Act of 2012<\/span><\/a> \u201c which failed to attract more than four co-sponsors. <\/span><\/p>\n<p class=\"p5\"><span class=\"s1\"><b><i>Renee Parsons<\/i><\/b><i> has been a member of the ACLU\u2019s Florida State Board of Directors and president of the ACLU Treasure Coast Chapter.
