{"id":121406,"date":"2019-04-23T12:58:28","date_gmt":"2019-04-23T16:58:28","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=121406"},"modified":"2019-04-23T12:58:28","modified_gmt":"2019-04-23T16:58:28","slug":"settled-lawsuit-proves-5g-advertising-is-fake","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=121406","title":{"rendered":"Settled Lawsuit Proves 5G Advertising Is Fake"},"content":{"rendered":"<h1>Sprint and AT&amp;T settle lawsuit over \u2018blatantly misleading\u2019 5G E logo<\/h1>\n<p><!--more-->By Adi Robertson<br \/>\nTHE VERGE<\/p>\n<p id=\"cGVTN5\">AT&amp;T and Sprint have settled a lawsuit over AT&amp;T\u2019s \u201c5G Evolution\u201d branding, which Sprint claimed was fooling customers into believing its 4G LTE network was a full-fledged 5G network. \u201cWe have amicably settled this matter,\u201d an AT&amp;T spokesperson\u00a0<a href=\"https:\/\/www.bizjournals.com\/dallas\/news\/2019\/04\/22\/at-t-sprint-5ge-deception-case.html?ana=RSS&amp;s=article_search&amp;utm_source=feedburner&amp;utm_medium=feed&amp;utm_campaign=Feed%3A+industry_7+%28Industry+Technology%29\">told the\u00a0<em>Dallas Business Journal<\/em><\/a>\u00a0\u2014 which cited anonymous sources saying that AT&amp;T would keep using \u201c5G E\u201d in its marketing material. AT&amp;T and Sprint also confirmed its statement to\u00a0<em>The Verge<\/em>.<\/p>\n<p><a href=\"https:\/\/www.theverge.com\/2019\/1\/7\/18172355\/att-fake-5g-logo-rolling-out-samsung-lg\">Earlier this year<\/a>, AT&amp;T started displaying a \u201c5G E\u201d logo on certain upgraded parts of its LTE network. The phones weren\u2019t actually connecting to 5G networks, and the move was roundly derided:\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/1\/7\/18173215\/tmobile-att-fake-5g-network-troll-9g-iphone\">T-Mobile<\/a>,\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/1\/8\/18173716\/verizon-5g-fake-icon-att\">Verizon<\/a>, and\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/1\/8\/18174386\/sprint-att-5g-icon-fake-misleading-response-verizon-tmobile\">Sprint<\/a>\u00a0all criticized AT&amp;T\u2019s new logo, with Sprint\u2019s CTO claiming it was \u201cblatantly misleading consumers.\u201d<\/p>\n<hr \/>\n<div class=\"c-float-right\">\n<h3 id=\"04MUJq\" style=\"text-align: center;\"><em><q>AT&amp;T WILL KEEP USING \u20185G E\u2019 IN ITS MARKETING MATERIAL<\/q><\/em><\/h3>\n<\/div>\n<hr \/>\n<p id=\"k1Y1TB\">A month later,\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/2\/8\/18216747\/sprint-sues-att-5g-evolution-e-lies-misleading\">Sprint sued AT&amp;T\u00a0<\/a>for false advertising, citing a survey where more than half of participants (incorrectly) said AT&amp;T\u2019s 5G E network had comparable speeds to real 5G. This was a bitter pill for Sprint, which is supposedly\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/2\/25\/18239508\/sprint-5g-launch-may-chicago-dallas-atlanta\">just a month away<\/a>\u00a0from launching its own 5G network. AT&amp;T defended itself from the charges, arguing that it had clearly distinguished the term from normal 5G, and that \u201ccustomers want and deserve to know when they are getting better speeds.\u201d<\/p>\n<p id=\"oF9vJH\">Both companies declined to discuss the agreement beyond noting that it was amicable, so we don\u2019t know what the terms of the settlement were. It doesn\u2019t sound like AT&amp;T is changing its practices, and we don\u2019t know whether it compensated Sprint in some way, or if Sprint essentially just dropped the case.<\/p>\n<p id=\"3MbKoA\">5G is still more promise than reality for most customers. Verizon has rolled out a network in Chicago and Minneapolis, but\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/4\/4\/18295600\/verizon-5g-network-first-tests-data-speed\">it\u2019s extremely spotty<\/a>.\u00a0<a href=\"https:\/\/www.theverge.com\/2019\/2\/25\/18239670\/tmobile-5g-launch-delay-second-half-2019\">T-Mobile delayed<\/a>\u00a0its main 5G launch to the second half of the year, when it will have phones that take advantage of the network. AT&amp;T debuted a true 5G network back in December, and it\u2019s available in 19 cities.
