{"id":120215,"date":"2019-04-04T18:47:41","date_gmt":"2019-04-04T22:47:41","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=120215"},"modified":"2019-04-04T19:04:42","modified_gmt":"2019-04-04T23:04:42","slug":"wouldnt-you-know-that-the-stupidest-lawyers-in-the-country-work-for-california-law-schools","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=120215","title":{"rendered":"Wouldn&#8217;t you know that the stupidest lawyers in the country work for California Law Schools!"},"content":{"rendered":"<h1>Cal Berkeley Law School Dean: Trump&#8217;s Free-Speech Executive Order Is &#8220;Unconstitutional&#8221;<\/h1>\n<p><!--more-->Campus Reform<\/p>\n<ul class=\"articleBullets\">\n<li>Two University of California administrators wrote in a recent op-ed that Trump&#8217;s campus free speech executive order is &#8220;unconstitutional.&#8221;<\/li>\n<li>The comments came after UC System President Janet Napolitano called the EO &#8220;unnecessary.&#8221;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<div id=\"attachment_120217\" style=\"width: 851px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2019\/04\/bigstock-University-Campus-UC-Berkeley-21483086_1.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-120217\" class=\"size-full wp-image-120217\" src=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2019\/04\/bigstock-University-Campus-UC-Berkeley-21483086_1.jpg\" alt=\"\" width=\"841\" height=\"600\" srcset=\"https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2019\/04\/bigstock-University-Campus-UC-Berkeley-21483086_1.jpg 841w, https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2019\/04\/bigstock-University-Campus-UC-Berkeley-21483086_1-300x214.jpg 300w, https:\/\/stateofthenation2012.com\/wp-content\/uploads\/2019\/04\/bigstock-University-Campus-UC-Berkeley-21483086_1-768x548.jpg 768w\" sizes=\"auto, (max-width: 841px) 100vw, 841px\" \/><\/a><p id=\"caption-attachment-120217\" class=\"wp-caption-text\">University Campus UC Berkeley, California, with golden bear and campanile visible.<\/p><\/div>\n<div>\n<p>In light of President Donald Trump\u2019s executive order on free speech, Erwin Chermerinsky, dean of Berkeley Law, and Howard Gillman, Chancellor of the University of California, Irvine, penned an op-ed in which they state that the executive order does not help protect free speech on college campuses and that it is even &#8220;unconstitutional.&#8221;<\/p>\n<p>\u201c[T]he order is so vague and ambiguous, it makes compliance by colleges and universities extremely difficult &#8212; and it is almost certainly unconstitutional,\u201d\u00a0<a href=\"https:\/\/www.law.berkeley.edu\/our-faculty\/faculty-profiles\/erwin-chemerinsky\/\" target=\"_blank\" rel=\"noopener noreferrer\">Chermerinsky<\/a>\u00a0and\u00a0<a href=\"https:\/\/chancellor.uci.edu\/about\/index.php\" target=\"_blank\" rel=\"noopener noreferrer\">Gillman<\/a><a href=\"https:\/\/www.latimes.com\/opinion\/op-ed\/la-oe-chemerinsky-gillman-trump-free-speech-college-201903222-story.html\" target=\"_blank\" rel=\"noopener noreferrer\">wrote<\/a>\u00a0for the\u00a0<em>Los Angeles Times<\/em>.<\/p>\n<p>\u201c[T]he order is so vague and ambiguous, it makes compliance by colleges and universities extremely difficult- and it is almost certainly unconstitutional.&#8221; \u00a0\u00a0\u00a0<span class=\"st_twitter\" data-layout=\"button\"><span class=\"stButton\"><span class=\"chicklets twitter\">Tweet This<\/span><\/span><\/span><\/p>\n<p>&#8220;There is no crisis concerning free speech on campuses in the United States,&#8221; Chermerinsky and Gillman add. &#8220;Every day on virtually every campus, speeches are given without incident, including some by very controversial speakers. Walk across either of our campuses on just about any day of the week, and the cacophony of diverse speakers is readily apparent.&#8221;<\/p>\n<p>The pair&#8217;s opinion of Trump&#8217;s executive order goes a step further than that of the University of California System President Janet Napolitano, who previously called the order &#8220;unnecessary,&#8221; but not &#8220;unconstitutional.&#8221; When asked to comment on the difference in language, a spokeswoman for Napolitano&#8217;s office referred\u00a0<em>Campus Reform<\/em>\u00a0to the UC president&#8217;s previous March 4 and March 21 statements.<\/p>\n<p>\u201cThe executive order that President Trump signed today is unnecessary. Like many higher education institutions across the country, the University of California is ground zero for robust exchanges of ideas and differing viewpoints,\u201d Napolitano, a former Obama administration official, wrote in her March 21<a href=\"https:\/\/www.universityofcalifornia.edu\/press-room\/university-california-responds-executive-order-free-speech\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0statement<\/a>.<\/p>\n<p>In a statement to\u00a0<em>Campus Reform<\/em>, Chemerinsky said, \u201cBerkeley\u2019s policies are open to all ideas and views. The campus has no discriminatory policies. Whether students and faculty are open to all political parties is a different question.&#8221; He went on to point out that Trump is the first to issue such an order: \u201cI do not think a presidential executive order is needed in this area. No prior president ever found the need to do this.\u201d<\/p>\n<p>Despite such claims, however,<a href=\"https:\/\/www.campusreform.org\/?ID=12017\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0Hayden Williams<\/a>, an employee of\u00a0<em>Campus Reform<\/em>&#8216;s parent organization, the Leadership Institute, was punched in the face in February while helping conservative student groups recruit new members.<\/p>\n<p>Fewer than two weeks after that incident, Napolitano released a<a href=\"https:\/\/www.universityofcalifornia.edu\/press-room\/statement-affirming-uc-commitment-free-expression\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0March 4 statement<\/a>\u00a0responding to Trump&#8217;s executive order announcement.<\/p>\n<p>\u201cPresident Trump\u2019s announcement of a possible executive order mandating that colleges allow free speech on their campuses or lose critical federal research funding is misguided and unnecessary,&#8221; the system president said. &#8220;UC already has clear policies and procedures in place that protect anyone\u2019s right to peacefully protest or speak on our campus.&#8221;<\/p>\n<p>Williams&#8217; assault by a former employee of the college reminded many of the 2017 riots that broke out at Berkeley over conservative provocateur Milo Yiannopoulos&#8217; scheduled appearance, a &#8220;March for Trump&#8221;\u00a0<a href=\"https:\/\/www.washingtonpost.com\/news\/post-nation\/wp\/2017\/03\/05\/pro-trump-rally-in-berkeley-turns-violent-as-protesters-clash-with-the-presidents-supporters\/\" target=\"_blank\" rel=\"noopener noreferrer\">rally<\/a>, and subsequent altercations.<\/p>\n<p>Despite all this, the university holds that the executive order is not needed.<\/p>\n<p>\u201cWe do not need the federal government to mandate what already exists: our longstanding, unequivocal support for freedom of expression. That tradition is alive and thriving on all of our campuses.
