{"id":100906,"date":"2018-07-10T22:03:22","date_gmt":"2018-07-11T02:03:22","guid":{"rendered":"https:\/\/stateofthenation2012.com\/?p=100906"},"modified":"2018-07-10T22:03:22","modified_gmt":"2018-07-11T02:03:22","slug":"theres-something-very-wrong-with-the-kavanaugh-nomination","status":"publish","type":"post","link":"https:\/\/stateofthenation2012.com\/?p=100906","title":{"rendered":"There&#8217;s something very wrong with the Kavanaugh nomination."},"content":{"rendered":"<h1>Liberals Are Freaking Out About The Nomination Of Brett Kavanaugh, But It Is Conservatives That Should Be Concerned<\/h1>\n<p><!--more-->by Michael Snyder<\/p>\n<p><a href=\"http:\/\/endoftheamericandream.com\/archives\/liberals-are-freaking-out-about-the-nomination-of-brett-kavanaugh-but-it-is-conservatives-that-should-be-concerned\/brett-kavanaugh-public-domain#main\" rel=\"attachment wp-att-8523\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-8523\" src=\"http:\/\/endoftheamericandream.com\/wp-content\/uploads\/2018\/07\/Brett-Kavanaugh-Public-Domain.jpg\" sizes=\"auto, (max-width: 515px) 100vw, 515px\" srcset=\"http:\/\/endoftheamericandream.com\/wp-content\/uploads\/2018\/07\/Brett-Kavanaugh-Public-Domain.jpg 515w, http:\/\/endoftheamericandream.com\/wp-content\/uploads\/2018\/07\/Brett-Kavanaugh-Public-Domain-300x183.jpg 300w\" alt=\"\" width=\"515\" height=\"314\" \/><\/a>The weeping, wailing and gnashing of teeth has begun on the left, but the truth is that Donald Trump could have nominated someone far more conservative on Monday night.\u00a0 Over the next several months there will be endless protests in Washington D.C. as liberals moan and groan about \u201cthe end of our freedoms\u201d, and Brett Kavanaugh will be relentlessly portrayed as a conservative devil by the mainstream media.\u00a0 And even though\u00a0<a title=\"NBC News\" href=\"http:\/\/www.nbcnews.com\/politics\/supreme-court\/trump-taps-federal-appeals-court-judge-brett-kavanaugh-supreme-court-n889921\" target=\"_blank\" rel=\"noopener noreferrer\">NBC News<\/a>\u00a0is insisting that Kavanaugh \u201cwould make the high court solidly conservative\u201d if he is confirmed, the reality of the matter is that there are some pretty good reasons why conservatives should be deeply concerned about this pick.\u00a0 Just because a Republican president nominates someone to the Supreme Court does not mean that individual will make a good judge.\u00a0 For example, Ronald Reagan nominated Anthony Kennedy in 1987, and he turned out to be a complete and utter disaster.\u00a0 If Reagan had nominated someone different, the entire modern history of the U.S. Supreme Court could have been completely different.\u00a0 With the Court still so divided, the stakes are incredibly high, and we must not get another Kennedy.\u00a0 So it is troubling that Brett Kavanaugh clerked for Kennedy and has always had nothing but good things to say about him.\u00a0 Anyone that would look to Justice Kennedy as any sort of a role model is definitely not fit for a seat on the highest court in the land.<\/p>\n<p>Beyond his connections to Kennedy, what is troubling conservatives more than anything are some of his opinions while serving on the appellate court level.<\/p>\n<p>For instance, not too long ago he ruled that an illegal immigrant\u00a0<a title=\"\u201chas a right to an abortion in the United States\u201d\" href=\"http:\/\/www.cnsnews.com\/news\/article\/terence-p-jeffrey\/trump-court-prospect-accepted-assumption-illegal-caught-border-has\" target=\"_blank\" rel=\"noopener noreferrer\">\u201chas a right to an abortion in the United States\u201d<\/a>\u2026<\/p>\n<blockquote><p>Judge Brett Kavanaugh, who was appointed to the U.S. Court of Appeals for the District of Columbia by President George W. Bush, accepted the assumption in\u00a0<a title=\"a dissenting opinion he filed last October\" href=\"http:\/\/cdn.cnsnews.com\/attachments\/garza_v_hargan-us_court_of_appeals-10-24-2017.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">a dissenting opinion he filed last October<\/a>\u00a0in the case of\u00a0<em>Garza v. Hargan<\/em>\u00a0that a teenage\u00a0illegal alien caught at the border and put in detention\u00a0has a right to an abortion in the United States.<\/p><\/blockquote>\n<p>In that opinion he also added that \u201call parties to this case recognize Roe v. Wade and Planned Parenthood v. Casey as precedents we must follow.\u201d<\/p>\n<p>Really?<\/p>\n<p>Throughout his entire career, Kavanaugh has been extremely engaged in Republican politics, but he has never expressed public opposition to Roe v. Wade a single time.<\/p>\n<p>So despite the outrageous claims of the left that Roe v. Wade \u201cis about to be overturned\u201d, the truth is that we actually have no idea how Brett Kavanaugh would rule on Roe v. Wade, and that is absolutely frightening.<\/p>\n<p>In addition, back in 2011 Kavanaugh decided\u00a0<a title=\"not to rule against Obamacare\u2019s individual mandate\" href=\"http:\/\/www.cnsnews.com\/news\/article\/terence-p-jeffrey\/trump-court-prospect-accepted-assumption-illegal-caught-border-has\" target=\"_blank\" rel=\"noopener noreferrer\">not to rule against Obamacare\u2019s individual mandate<\/a>\u2026<\/p>\n<blockquote><p>Judge Brett Kavanaugh, who was appointed to the U.S. Court of Appeals for the District of Columbia by President George W. Bush, declined to rule against Obamacare\u2019s individual mandate\u00a0<a title=\"when it came before his court in 2011\" href=\"http:\/\/cdn.cnsnews.com\/attachments\/seven-sky_v_holder.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">when it came before his court in 2011<\/a>\u00a0and argued that the case could not be decided by a federal court until at least 2015 because of the Anti-Injunction Act.<\/p>\n<p>All nine members of the Supreme Court\u2014including Justices Antonin Scalia, Samuel Alito and Clarence Thomas\u2014would later\u00a0<a title=\"join in opinions\" href=\"http:\/\/cdn.cnsnews.com\/attachments\/nfib_v_sebelius-supreme_court.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">join in opinions<\/a>\u00a0(in the Obamacare case that the Supreme Court decided in 2012) that rejected the argument Kavanaugh embraced that the Anti-Injunction Act prevented a pre-2015 ruling on the Obamacare mandate.<\/p><\/blockquote>\n<p>All of the \u201cexperts\u201d on television keep telling us how \u201cconservative\u201d Kavanaugh is, but looking at his record that is hard to see.<\/p>\n<p>And let us not forget\u00a0<a title=\"his extremely close ties to the Bush family\" href=\"http:\/\/www.nbcnews.com\/politics\/supreme-court\/trump-taps-federal-appeals-court-judge-brett-kavanaugh-supreme-court-n889921\" target=\"_blank\" rel=\"noopener noreferrer\">his extremely close ties to the Bush family<\/a>\u2026<\/p>\n<blockquote><p>Following a brief period in private law practice, he became Bush\u2019s White House counsel and then staff secretary before he was nominated to be a federal judge. He met his wife while working at the White House, where she was the president\u2019s personal secretary.<\/p><\/blockquote>\n<p>Donald Trump likes to think that he is making his mark on the Supreme Court, but the reality of the matter is that we probably would have gotten the exact same nomination if George W. Bush was still in the White House today.<\/p>\n<p>I hope that he proves me wrong, but I believe that the nomination of Kavanaugh is a huge mistake.\u00a0 I believe that he is a moderate, especially on social issues, and I do not trust him.<\/p>\n<p>But most conservatives are going to assume that Kavanaugh must be wonderful since he is \u201cTrump\u2019s choice\u201d, and they are going to rally around him.<\/p>\n<p>Instead, it will be the left that will try to keep Kavanaugh off the Court, and within minutes of the announcement of his nomination there were already hundreds of protesters\u00a0<a title=\"on the steps of the U.S. Supreme Court building\" href=\"http:\/\/www.usatoday.com\/story\/news\/2018\/07\/09\/hundreds-protest-supreme-court-after-trump-nominates-kavanaugh\/767834002\/\" target=\"_blank\" rel=\"noopener noreferrer\">on the steps of the U.S. Supreme Court building<\/a>\u2026<\/p>\n<blockquote><p>It didn\u2019t take long for protests to start. Around 15 minutes after the announcement, chants had shifted to \u201cHey Hey, Ho Ho, Kavanaugh has got to go.\u201d Some protesters had makeshift signs that had been updated with the nominee only minutes after his announcement.<\/p><\/blockquote>\n<p>And of course good old Bernie Sanders was on hand\u00a0<a title=\"to whip the protesters into a frenzy\" href=\"http:\/\/www.usatoday.com\/story\/news\/2018\/07\/09\/hundreds-protest-supreme-court-after-trump-nominates-kavanaugh\/767834002\/\" target=\"_blank\" rel=\"noopener noreferrer\">to whip the protesters into a frenzy<\/a>\u2026<\/p>\n<blockquote>\n<p class=\"p-text\">Sen. Bernie Sanders, D-Vt., told the crowd of protesters that they should be ready to challenge the nomination.<\/p>\n<p class=\"p-text\">\u201cAre you ready for a fight?
